I recently received an ITA after waiting for 2 years in express entry pool. my issue is that my brother doesn't hold a legal status in Canada. He came to Canada after 12th on study permit and then covid happened and he couldn't find a job and was not able to go to school and got depressed. he didn't tell anyone about his situation because he was scared i came to know when i saw him suffering from mental health issues. I hold a legal status in Canada and few days ago i got my ita and there is a form where i have disclose my family members. i am worried and dont know wht to do. if anyone knows anything please let me know.

It doesn't matter. Your brother is not a dependent in your application. This will have no impact on your application.
 
Thanks but is there any solution to make his status legal in canada or not?
Realistically speaking, no, especially if he does not have a job or he quit his studies.
Technically, there is the H&C path that has to be done through a lawyer but I'm going to take a stab and say that it is unlikely this will be granted.

How long has he been in Canada? If he never studied his permit should have been cancelled soon after arrival. How old is he now? Where are you from? Would he be able to pursue further education in your home country? If he only has grade 12 and is illegal there aren’t great opportunities for his future. You are required to show funds to be able to get a study permit so not finding employment right away should not have prevented him from studying especially the first year. He may have been able to obtain things like a SIN#, a health care and be still using his study permit as proof that he can work even if the study permit was likely cancelled a long time ago. At a certain point these things will expire so life without status will become even more difficult.
