Received ITA before gain 2 years experience

Hi, all

I believe there are some kind of posts already exists, but I am still need more voice from somebody have experience on this.
I worked as fulltime started from 2018.07.27, but I got the ITA on 2020.06.04. Basically it needs another 53 days to right on the date of 2 years experience.
Obviously, I wouldn't be received the ITA without the extra year points.
The question is, do I have to decline the ITA? or I can wait till 2 years, then create a profile and submit the application?

Your work experience/history must be true at the time you accept the ITA. So if you accept it now but don't submit it/receive AOR until after completing 2 years, the immigration office can still reject your application. One of the fields i've seen on GCMS notes is where they verify your NOC and work experience at the time ITA is received. So if they receive the application, see that your work experience is actually 1 year 10 months and it causes your score to drop below the minimum cutoff during your draw, your application would be rejected.

Thanks for the input @Jaybird94. It's that ok for accepting the ITA on the date when it completing 2 years (let's say July.27)? and then submit the application right away before the 60 days period.

Under section A11.2, an officer may not issue a visa to an applicant who did not or does not meet the Express Entry minimum entry criteria (MEC) or did not or does not possess the qualifications for which they received their CRS score at the time when

the Invitation to Apply (ITA) was issued; or
the e-APR was received by IRCC.

The part about the system awarding points a month early is discussed on a daily basis, it is because the profile only asks for MM/YYYY instead of MM/DD/YYYY. Because of this, the system "assumes" that your start date is on the first of the month, and the end date is the last day of the month. In fact it could be the opposite and give an ITA up to 2 months too soon.

This has also been discussed many times, but a lot of people find it difficult to distinguish between "Minimum Entry Criteria (MEC)" and CRS points.

For the MEC (e.g. one year minimum of skilled work experience in Canada to qualify for CEC), you must meet the requirement at the time of the ITA.

For CRS points (beyond the one year), you are OK if you meet the requirement at the time you submit your eAPR.

Since you are talking about the CRS points for the 2nd year, and not the MEC, you will be able to keep the points for the 2nd year, as long as you have completed 2 full years of employment at the time you submit the eAPR. If you do not complete the 2nd year before your permit expires, you won't have earned the points for the 2nd year; if you applied anyway, your CRS score would be recalculated and you would (likely) be refused.

There's no clear answer in my opinion even though the post above says the experience at e-APR is what's looked at. If you search on these forums, you'll see people being Rejected because they accepted ITA before finishing 2 years, and people who made it through as well. What my opinion is, if you would not have received the minimum cutoff without the 2 years completion, you should reject the ITA. This would just put you back in the pool. If your timeline was closer (like 1 week cutoff) you could still "risk" it, but with the 50+ day gap you mention, I wouldn't risk it unless you have plenty of time and don't mind going through the ITA/PR process again in the future if this one is rejected.
