Hi, I received my invitation to apply last night. I am planning to make my PR application asap. However my LMIA will expire at the end of July along with my contract at work. If I am not extended in my current role, what would happen with my PR application, which would presumably still be in process at this time? Would I no longer be eligible and have my application returned?

The LMIA was valid when you were nominated, so you can go ahead with your application. We were in similar situation few weeks ago and our immigration consultant submitted our application few days before the LMIA expired. I would apply asap, but once you apply, you don't have to worry about your LMIA being expired. We were on LMO based skilled worker WP and applied on April 29, our WP expired on May 5th and since then we are on implied status and we applied for BOWP through our consultant.

submit your application asap and when you get aor apply for BOWP.

Thanks very much for the responses, that's good to hear. I'm hoping to get the application submitted within the next few days, just waiting on a police certificate.

Then you should be all good to go. Till you get BOWP you will be on implied status and can keep working for the same employer. The main point now is to submit complete application before LMIA expires.

As long as you applied for WP extension or PR, you are eligible to work for the same employer until the decision is made whether BOWP or PR:

Can you clarify something for me? My wife is currently on a LMO based work permit that expires on June 26, 2015. She received ITA yesterday. We are unsure if that will leave enough time to submit her application as she will need to schedule a medical exam and request a police clearance certificate.

Are you saying that as long as she received the invitation to apply before it expired that she will be ok and has the full 60 days to apply, or must she submit her complete application before June 26?

To be on a safe side, I would apply before the LMIA expires, but the understanding I got from our immigration consultant is that the LMIA needs to be valid at the point you are nominated, but i can't say 100% because I don't wana mystify you in any way. We were pushed by our immigration consultant to apply asap to keep the implied status, because once your WP expires and you didn't apply for your PR yet, you need to wait for your PR on visitor visa (which I've heard is not very much recommended), or outside Canada.
