Definitely not. if you are working and not sitting idly it's not regarded as gap. My relative got under SPP with experience of 7+ years last year only.
There are lot of cases on this forum who have been through with a study gap (but with experience in between) of 5+ years.

As Harvijay pointed chances are more of the FBI clearance report.

Perhaps but then the refusal reason would be "Your proposed studies are not reasonable in light of.... etc etc"
