Hi All,

Could you please provide your input for the below situation. Your reply is very much appreciated.

I am working in software industry and have been deputed to Canada to work for Canadian client A from June 2009 till August 2012. I went back to my country in September 2012 and came back to Canada in May 2013 to work for Canadian Client B.

I have got the below 4 work permits while I was working for Client A
Period of work : June 2009 till August 2012
Work Permit NOC Code Title on Work permit Role as per Employer letter submitted for Work Permit
Initial 2174 Embedded Sys Software Designer Software Developer
1st Extension 2174 Embedded Sys Software Designer Software Developer
2nd Extension 2171 Computer Analysts & Consultants Quality Analyst Lead
3rd Extension 2171 Computer Analysts & Consultants Quality Assurance Analyst

I have got the below work permit this time when I came to work for Client B
Period of work : May 2013 till February 2015
Work Permit NOC Code Title on Work permit Role as per Employer letter submitted for Work Permit
Initial 2283 Inform. Syst. Testing Technic Software Tester

I have applied for PR under CEC category in 2011 upon completing 2 years and got refusal as I couldn’t provide employer reference letter confirming duties, responsibilities and hours of work over that period of time. My employer was not providing this letter at that time.

Now I have gathered all the employer letters that were submitted along with my work permit applications which mentioned my roles & responsibilities. I am also getting Employee letter stating my employment with the company, role and my assignment dates in Canada. But this letter doesn’t mention number of hours worked and list of responsibilities. My employer has started providing this letter recently.

I am planning to reapply for PR under CEC category and claim the experience for the period June 2009 till August 2012. I have the below doubts and seeking your valuable feedback…
1. Do I need to mention all the above NOC codes in “IMM 0008 Schedule 8 Economic Classes” application form
2. Do I need to use the titles mentioned in the work permit or the titles mentioned by my employer in the work permit letters for the Occupation column in “IMM 0008 Schedule 8 Economic Classes” application form
3. Do I need to ask my employer to match the role in their reference letter (to be provided) with the title mentioned by them in the employer letter submitted for work permit applications
4. Can I use the pay stubs to prove that I have worked for 40 hours each week
5. Do I need to specifically mention that I want to claim a portion of my work towards CEC application or is it not required? (for example period from 2nd work permit extension till I left Canada in October 2012)
6. Do I need to attach any covering letter
7. Do I need to submit reference letter from my manager/colleague listing the roles and responsibilities for the above period.
8. Do I need to use my Client A dates while filling “From Date and To Date” for question 10 under Personal Details in “IMM 0008 Generic Application Form For Canada” application form or do I need to use my Client B dates for this field which are July 2013.
9. Any suggestions on applying through an immigration specialist based on my situation or can I apply myself. Last time I went through an immigration specialist.

Sorry for the lengthy content. I am trying to be very cautious this time as I have a refusal in the past due to missing reference letter.

Yes

Title mention by employer reference letter, wait for senior advice too

Yes all title should be same, you don't wan to cause any confusion

If ur using reference letter which says your hour that's enough. Infant they are must...pay stubs are not needed

They will count your work exp in last 36 month and it should be one year

It always help. Just tell them documents enclosed

Yes, reference letter from manager or HR of a company on company letter pad mentioning
Experience,hours ,salary , title, responsibilities

Keep in my mind u need 12 months of experience, acquired within last 3 years.

But i think you are good to go.

Hi,

I am facing same issue as yours, I have been requested to provide Employment Letter for my work experience in Canada.I have already provided the employment letter with my initial application but still I have been asked to provide the employment letter again.

Can you please advice which all documents should I send to immigration as you have already gone through this you can provide a better suggestion

Yes. You need to provide an NOC for each position you performed in Canada. If you changed positions/roles even with the same employer, you provide the new job title/NOC. If you were doing the same job but for some reason the NOC changed on your work permit, choose the NOC that best represents what you actually did (as attested in your Letters of employment).

You need to use the job title(s) given to you by your employer

The reference letter should describe the duties and responsibilities you actually performed. Since it appears you performed those duties and responsibilities for a client, not directly for your employer (who is not in Canada?), you should probably try to get letters from the Canadian client(s) as well.

This MUST be part of the Letters of employment. If you absolutely cannot get that, then if your paystubs do indicate number of hours worked per week, then it may be accepted as long as you provide a written explanation. Another option would be to get the Record of Employment from Service Canada - that will show the cumulative number of hours per week for each job/position that has come to a end (you can't get an ROE for a job you are still doing).

Not necessary.

Only if there's something that requires explanation, where your application or experience doesn't "fit" the generic rules...

Not sure what you mean -from the client company? If that's what you mean, I would recommend it, yes, in addition to the letter(s) from your employer.

You mean current country of residence? Since you were a non-resident between your two clients, you can't use the first period. Date the current country of residence from your most recent period of residence.

Only you know the answer to that. Most here do it themselves...
