I was refused visiting visa to reunite with my family in Canada. My wife is on a study permit, and she is in Canada with our son.
I wish to reapply, can my elder brother who is a Canadian citizen invite me instead of my wife. Will I have a greater chance of
the visa approval, if my brother does the invitation and covers the journey expenses?.
What do you advice. Please give your professional candid opinions.

Thank you in anticipation.
Izy.

What do you advise. Please give your professional candid opinions. Is your spouse doing a masters or PhD? When did they start their studies? Does your child have a study permit or do they just have a TRV?

Thank you in anticipation.

No it won’t help and not a great idea to lie to IRCC who will compare to your previous application. You need to show you can afford to pay for travel yourself. Having you family in Canada makes your ties to Canada extremely strong. Unless you qualify for an OWP you would have been aware that there was no guarantee you could visit your family in Canada. Your wife and child may have to visit you. Would add your child may also struggle to remain in Canada as well longterm.

You should be funding your trip as well . If you can’t afford to fund the trip , then it further weakens your application.
As well your spouse /child and your brother all are here . Further weakens your application to return .
You are the tie for your spouse / child to return after she’s done her education.

The officer will compare both applications and see you’re changing your situation.
As mentioned you should of been aware when your spouse decided to come to Canada , that you might not be able to visit them

Thank you for this explained reply by Copingwithlife.
I really want to visit my family, my spouse is on a three years course, does it mean we will be disconnected for three years?
What should I do, since I do not want to abort her studies?
Your candid advice will be highly appreciated.
Thank you in advance.

What should be the available options?

What were reasons for refusal? You don’t have family ties outside Canada so chances are low you will be approved. Can you meet outside Canada if you want to see your spouse and child?

Thank you Naturgrl for your response.
No tangible reason was given. It only bordered
on the facts that the immigration officer feels that I won't
leave Canada.
What are other options available for me?

What do you mean by options? Assume spouse is not in a degree/masters program so you are not eligible for SOWP. You meet in another country. Don’t know reasons for refusal.

By options, I mean other legal pathways to enter Canada aside spousal or brother's invitation.
Thank you.

Again you don’t say reasons for refusal but assume it is because of family ties, and all your family is in Canada. An invitation is the least important document as you need to show ties to return to home country, family ties in home country, travel history and funds.

So if not coming as a visitor then you need to look at immigration programs or find a job with LMIA to apply for a closed work permit.

I am waiting for the GCMS note which we already applied for, the only reason shown in the refusal letter was that the immigration officer was not convinced that I will leave Canada on visit.
Thank you.

Correct because your family lives in Canada which you cannot change. So IRCC doesn’t think you will leave. What absolute proof can you show that you will leave.

I am on a full time employment here with evidence, employment letter, statement of account showing monthly salary payment, I can only apply for visit based on my annual leave approval, I have property documents and enough fund to take care of my trip, I have a proof of one year fully paid rent because I am on annual rental. What other documents will be needed to convince the immigration officer, I may be omitting some, having the list of supporting documents that will help will be appreciated.
Thank you.

But your family is all in Canada…that is the issue. Do you live in country of citizenship? Your only proof of return is a job. Wait for GCMS notes and reapply. Your spouse most likely has summers off so can come and live with out in the summer months.
