Ok so heres my stpry and I am asking for some insight. Im canadian spouse is american have been living in the states for 3 years I have my green card. Husband lost his job we wanna move back to canada. We are hoping to leave in september. Plan would be to drive in and cross the border. Now my real question is is this possible. Can we cross the border by land explain tp the customs agent that we are wanting to move here and we wpuld be filing for him to be a PR.. any answers would be greatly appreciated

It would be best if you apply for PR first and take proof of the application with you. If you haven't applied for PR and show up at the border with a moving truck, there's a good chance he will be denied entry.

It's best he cross alone with only "visitor" possessions. No furniture, household items, appliances, etc. But you can try together and hope you get a nice IO - with proof of a PR application already in process.

Ok yes we definitely dont want any bumps in the road. Thanks for the advice. We could definitely start the process here is there a good success rate with this if we started here then crossed over with proof? Or wpuld the way tp go be flying together with just visiting purposes and apply when we are there? If so how long after do we have to apply can he stay there as long as the process goes on for???

IMO....I would not just show up at the border and tell them your/he's moving in....

That will get you/him turned around and sent on your way back for sure.

You can send in an outland application before even coming. Which, once approved to sponsor, (about 30 days) would give you proof at the border. Everything else your asking can and has worked for others. Just make sure you call it a "visit". He's helping you move back and going to see you settle in, visit family ect. then return.

Generally, the IOs at the border are fairly lenient to Americans that are being sponsored. Generally. Not always, but usually. I know of people that did show up at the border with the U-Haul and their Canadian spouse, showed their PR application proof and were let in. NOT what I would recommend, but it does happen. (Being married for at least a few years seems to be a factor.)

Spouses generally do better when crossing with their Canadian sponsor. When the Canadian makes the request to have the American enter, it seems to hold more weight than an American requesting to stay long term.

So there's no real "correct" answer. If your husband can get a letter from his job saying he's due to return on X date or buy a refundable plane ticket to leave Canada, that would really help. (You obviously return the ticket once you're in Canada - there's usually a small fee to refund it.) That way, if you do take him over the border with you, his story of helping you move carries more weight.

Collect as many opinions as you can and decide what is best for you. Best of luck!

Thanks so much for the advice this all for sure makes sense. I was thinking of calling the number on the cic website and ask this question also. I do know of a girl who did the k1 visa and then they did exactly what I was planning on doing and were let in but having the proof makes way mpre sense
