Hi
I need advise on TRV from india for my uncle and aunt for three weeks visit
They have three childern .The eldest daughter is PR in Canada. The younger son and daughter are in Canada on student visa.
They have received invitation from PR daughter in Canada .The son has also got invitation for parents for convocation .

The uncle has a house in a premier city in Punjab and agriculture land .He has FD for about CAD 30000.He has form J for sale of grains.He is not filing the tax return as agriculture income is exempt from income tax.

The aunt has no bank account or assest in her name

Please advise if both can get TRV if they apply together as all childern are in Canada

What documents should be attached in EACH application based on above facts. We are planning to attach

- Valuation and ownership of property
- bank letter for funds
- regular agriculture income proof - Form J
- Letter of financial support for Aunt from Husband
- Invitation letter from PR daughter , PR card copy and Tax assessment
- study visa for son and daughter

1. Do your uncle and aunt live with any other dependent family members? For example, their parents/in-laws?

2. Is your uncle a farmer i.e. works on the agriculture land? Or does he trade in grains? Or does he live in the city? This is not clear in your post.

3. If he lives in the village then does he earn a rental income for the house in the city?

4. Is the FD locked-in? Do they have adequate liquid finances i.e. bank balance to pay for their visit?

5. Does he employ anyone? Can he provide evidence of this?

6. Has he taken loans for farm equipment, vehicles, etc.... or mortgage for the house? If yes, these can be reasons to return to Punjab.

7. Apart from their children, do they have other close relatives in Canada (for example, their siblings)?

8. Have they traveled to countries like the US/UK/Schengen area?

Even if you prepare a stronger application with more evidence of your ties to Punjab.... the refusal reason which you should be concerned about is this one i.e. you have not answered all questions truthfully.

You must re-check your previous application to see if any details that you had provided were incorrect/false.

Maybe it is best if you order GCMS notes first to understand why the visa officer has checked this refusal reason. Your nephew can order it on your behalf

The point wise information is
1 Yes He has his old mother living with them
2 He is himself a farmer
3 House is partially rented but no lease deed is signed.
4 The FD have no loan against these and can be encashed anytime .Asking bank to certify that,
5 He employs casual labor as required.
6 No loan is pending
7 My uncle has one one brother residing here
8 No travel history
We have decided to apply TRV for for my uncle only and my aunt will stay back.
We hope this will make ties to India strong and he will get TRV.

He is explaining that

Although the PR daughter has included both parents in invitation He is applying alone and saying in letter of explanation that my wife will stay back with my aged mother
Further mentioning that he is required to be back in India for transplantation of rice crop in July .The visit is planned for 3 weeks in June

He is enclosing
For ties to India he is including property tax receipt for house and ownership proof and self evaluation of property.

For regular income Form J for sale of crops showing amount. as he is not filing tax returns for agriculture income
For financial position letter from bank the FD can be en cashed anytime at discretion of customer

Pr card copy of his PR daughter and recent utility bill for phone. The papers for student status of other two childern in Canada

IMO, he does not have a strong case especially for purpose of visit, travel history, family ties in Canada and finances. What would work in his favour though is that your aunt/his mother are not accompanying him + he owns a property. The purpose of visit is to meet his children in Canada
1 The invitation letter from PR daughter is being arranged for her father only.
2 The proof if family members living together in india shall be provided.
3 The property valuation shall be supported by a page on government list on website
4 He has got recent funds in savings account from sale of Grains and is supported by form J
5 The casual labour is paid in cash and difficult to prove.

I suggest:
1. Prepare a day-by-day itinerary for sightseeing/visiting friends and relatives, etc


2. A cover letter with separate sections for Applicant details + Host details + Purpose of Visit + Funds available for my visit (include the bank balance + FD amount) + My Strong Ties to India (sub-sections, point-wise info for Property + Agriculture land + Finances + Family (immediate and extended family, broadly list out the extended family without giving names and details) + Why I must return to India by XX date

All amounts stated must be in INR and CAD


3. Property valuation: Pages from Times Property, Magic Bricks, 99acres (if available).

I would not quote property rates from the government website/government property reckoner as those are unrealistic/not market-realistic values + indicates depreciated prices (instead of indicating an appreciation in the property value).


4. An explanation must be included about this recent funds received from the sale of grains, including any receipts/payment transfers + Form J


5. Any evidence (if possible) of why he must return by XX date for the rice crop before the onset of the monsoons. For example, evidence such as payments (in advance) for buying seeds, chemicals, etc
