Re open ITA PR file after rejection

Hi all,

I had ITA in month of July. I had everything good. Lawyer made mistake and was rejected last week on oct 13,2015.

Reason for rejection- My spouse police clearance submitted was from November, 2014. He had done it again in August, 2015. Lawyer uploaded the old copy from nov 2014 which is considered expired due to older than 6 months.

Question for you guys:
1. Can I reopen my case?
2. How do I do it?
3. How long does it take?

The police certificate does not expire after the 6 months...based on the new changes see below with bold

Who needs a police certificate?
In general, you and all the people in your family who are 18 or older need to get a police certificate. You must get one from each country or territory where you have lived for six or more months in a row since the age of 18. (For example, if you lived in a country for eight months but left on a two-week vacation, that counts as living there for eight months.)

For the country you currently live in, the police certificate must be issued no more than six months before you apply.

For countries where you have lived for six months or more, the police certificate must be issued after the last time you lived in that country.

If your certificate is in a language other than English or French, send it when you apply, along with the original copy of a translation done by a certified translator.

@exp7, police certificates does expire! Different countries have different expiration date! It may range from 3-6months or maybe one year!
Where I come from, police certificates are only good for three months!

maybe expire for use in the country you come from, but you have to see the rules of Canada which means based on Canada's requirements what considers that expires or not, your police certificate you have is good.

Not completely correct.

For the country where you currently live in, PCC is valid for only 6 months from date of issue regardless of any expiration date mentioned in it.

It doesn't expire to be used in my country! It expires to be used as a valid police clearance to travel to other countries! The point I'm trying to point out here is police clearance certificate does have expiration date, and to meet Canada's requirement it has to be valid!

Police certificates usually do not have expiration date; it is only mentioned the date of document creation and/or printed.

If you are in Canada you do not need a police certificate from Canada; however, you need a police certificate for the countries you have lived based on the following rule:
For countries where you have lived for six months or more, the police certificate must be issued after the last time you lived in that country.

If you apply outside of Canada then you have to follow the following rule:
For the country you currently live in, the police certificate must be issued no more than six months before you apply.

Of course you can write a CSE, attach the correct document, and ask that they reopen your case. But when lawyers or consultants make mistakes, those mistakes are attributed to the applicant, and in general CIC seems to re-open only those cases in which the mistake was CIC's, not the applicants.

Because of that, you should also make a new EE application and re-enter the pool. And remember that if you don't live in Canada, you need a new certificate for the place you live in every six months.
