re entering canada after 2 years 11 months gap

Hi

My son was out of canada for 2 years 11 months. now i am bring him back to canada. what kind of problem he may face as he only stayed for 40 days during his first visit in 2013. his PR card is valid till june 2018

even i was out of canada for 6 months but stayed in canada for about 8 months...i am concerned about my son who is 14 years old...his exam were over this month as he was studing in INdia

plz advise to prepare for landing

Perhaps there will be some questions, some cautions, but the likelihood is there will be NO problems related to residency obligation concerns.

For a PR within the first five years of landing, the critical threshold is not being outside Canada for a total of 1095 or more days.

But practically, for a PR with his or her first PR card, returning to Canada with two years left before the expiration of the card should not invite any serious questions about compliance with the PR RO. Again, a conscientious PoE officer might remind the PR of the PR RO, but otherwise there should be no PR RO issues.

Of course cutting it this close means the PR should stay in Canada for nearly two years without leaving.

Also note that there will generally be more flexibility allowed for a minor dependent.

Apologies for intruding but mine is the second PR Card and I have lived almost 2 years and 8 months outside canada and will not return before December 2016. Although my PR card is valid will there be any problem when I return in December this year.

If you have been outside Canada 2 yrs and 8 months as of today, then as of December you will have been outside Canada around 3 yrs and 4 months. So you will be in violation of the residency obligation. It doesn't matter if you have a valid PR card or not, upon entry to Canada there's a good chance CBSA will report you for not meeting RO, and will start steps to revoke your PR status. You will be allowed to remain in Canada and appeal this, if you think you have a valid H&C reason.
