Re-Applying for Study Permit after 5 month overstay

To all it may concern,

I was wondering what are the chances of getting approved a Study Permit when applying from home country after overstaying my last permit by five months.
Been in Canada since March 2010, graduated high school in Canada only, and have one year left of university. I have never overstayed and never engaged in anything illegal, yet due to some intense emotional trauma family wise, I overstayed my permit by five months. I did not go to school during this time and am so close to graduating.

I left Canada though voluntarily, no deportation or departure orders permitted. All my family is in my home country and have no intention of coming to Canada, and I would go back more than twice a year before the overstay to visit them. I am a single, unmarried girl who realises
her mistake severely and just wants to graduate from the same university and come back and work at home.


My questions are as follow:

1) What are my chances of being approved another study permit if I apply from my home country and explain my situation? Will my chances improve if I apply with a new passport?

2) As my aunt lives in New York City and my mother graduated from school there, I have a valid US visa for a couple more years. Will my chances improve if applying from USA? I understand study permit applications go through LA Embassy. Thus, would they be more sympathetic and understanding than those in my home country?

3) If refused the Study Permit, what are my other options. Is it possible to apply for a Temporary Resident Visa and then change status from within Canada?

Given the fact you are from Pakistan and overstayed in Canada by 5 months, your chances are almost none. You can try for sure.

Apply from your home country for the study permit. Make sure you are 100% honest in the application (the fact you have a new passport doesn't hide your past immigration history) and provide strong evidence of proof of ties to your home country. There's always some chance you may be approved.

Applying from the US won't increase your chances. If anything it might increase the chances of refusal since it will be more difficult for you to demonstrate proof of ties to your home country and make CIC suspect you're looking to remain in North America long term.

If the study permit is refused, the most TRV likely will be as well.

Thank you for your responses. Scylla, in terms of establishing strong ties to my homeland, what are some things that might strengthen my case to return back home to work. I only have eighteen credits left and since I have invested a majority of my time in the Canada, would prefer to complete my program there.

I understand family business, property, etc. My program is psychology and my father is one of the best doctors here, my family has held strong government positions, etc. I have worked here during the summers as well before. The immigration officer should be able to see my travel history as well and how often I would fly back home.
