IRCC should seriously consider such kind of cases, I don't see how and why you're inferior to someone who submitted their profile at 439 on February 5th!!

All applicants on the same cut off score are ranked according to their profile creation date.

CIC just selected the top 3900 ranked applicants from the pool today, so obviously whoever is ranked 3901 would miss out on an ITA.

Even if they do the ranking using a different criteria, whoever is ranked 3901 will miss out.

Tie-breaking rule: February 6, 2018 at 19:31:37 UTC

1) Everybody with CRS 440 and above gets an ITA irrespective of their profile creation date.
2) Everybody with CRS 438 and below miss out on an ITA.
3) Those with CRS 439:-
a) Get an ITA if they created their profile on or before February 6, 2018 at 19:31:37 UTC
b) Miss out on an ITA if they created their profile after February 6, 2018 at 19:31:37 UTC
It means I missed it...with 439 nd submitted file in June end
 
Congrats for those who received the ITAs!!!...
I just submitted profile yesterday and is with 449 points; any idea if it will be picked up in the draw?

But the problem is that I had applied as legally separated. We have been separated for about 4 years already. She had also told me that she was ready to sing the uncontested divorce. But now all of a sudden she doesn't want to do that and told me to do whatever on my own.

There is also zero chance of getting a police certificate for her.

Should I quickly file for a divorce on my own? Or, should I just forget about responding to the ITA?

Also, I am new here, so could you, please, suggest me the right forum to ask such a question here.

Is your calculation actually giving out a cut-off of 439 with a 14-day draw next? I thought currently the pool intake rate is about 280/day above 440. That would mean about 3900 profiles entering by 2nd Jan above 440. So, cut-off should be 441 or at least 440, isn't it? I missed out on 439 at tie-breaker today, and seriously gave up hope in near future with regular 2 week draws. But I have more faith on your prediction above everything else on this forum :)

Historically the year end weeks (Christmas and New Year) have resulted in lesser numbers of applicants entering the pool than normal. I am not sure if it is due to lesser ECA outcomes due to Christmas holidays or any other reason.

You can do a quick check on last years draw data and see the situation.
Nov 15 - Dec 6: 3 week gap - 2750 applicants got into pool with CRS 452 and above
Dec 20 - Jan 10: 3 week gap - 2750 applicants got into pool with CRS 446 and above

Hence, I have accounted lesser than normal average intake of 265-270/day for CRS 441 and above.

I know man, I understand the tie-breaker concept, just getting my frustration out :)
But seriously, this tie-breaker is a really heartbreaking concept, especially for those who have birthday shortly afterwards. Why couldn't they decide they will give out about 3900 ITAs, see that it means CRS cut-off is coming to 439 and then increase the draw size a bit to accommodate everyone with 439? The way they used to do till 2017.:confused:

I agree. I am feeling a bit dejected. I missed the tiebreak by a day.
