Hi all, my Refugee was Rejected in November 2022 based on Credibility. I filed an Appeal through my Lawyer to the RAD in December 10th 2022.

This week i got a notice from RAD that they will be considering 3 new issues namely,
1. IFA
2.State Protection
3. Forward Looking Risk

And they will be considering the updated National Documentation Package of November 2022 in making their decision.

They advised the the Minister and my Laywer to make submission on or before April 21st,2023.

I am from Nigeria and my timeline is below
Made Refugee claim in October 2021
Hearing done September 2022
Negative Notice of Decision November 2022
Appealed to RAD December 2022
Notice from RAD that they will be considering 3 new issues April 4th,2023

Wouldn’t consider it a positive but it does give you a clear idea what the arguments will be so you can plan in advance to address these issues during your appeal.

Reading from previous post, you said you are from Ghana but now Nigeria. Given lengthy of your hearing 3hrs with 3 breaks with Minister Intervention, and the fact that two issues were added on top of credibility, its a tough one and work closely with your lawyer to make submission for both IFA, State Protection and Risk. Familiarize with Prudential Guidelines recent issues on issue no 3 provided your case is gang related, number 1 was revoked for Nigeria but give it enough consideration as well. You may find reference cases as well..your lawyer should know better.

Thanks Simba, for the information. I provided my lawyer some new evidences that weren’t available at the time of the hearing and he made the submission to argue the IFA and state Protection. Will update when a decision is made. Thanks

I got a call from my lawyer yesterday afternoon that Appeal was successful.
The Member dismissed the RPD’s negative decision and substituted it will a Positive decision, that she finds me to be a Convetion Refugee.

The Origanal RPD hearing was rejected based on Credibility and the member was very biased and made lots of mistakes in his decision. I remember him mentioning in his decision that some of my answers to the questions he asked me were VAGUE. I dont think that is a right word to use .

I am so so grateful and dont even know how releived i am right now. I just wanna say that this forum has been really helpful in terms of information gained from senior members here.

I pray for more Positive decision for the rest of the people still waiting for decision.
