My work permit expired in june 2011, unfortunately i didn't apply for restoration within 90 days but my LMO was in process. After 94 days i received positive LMO which i sent to CIC Vegreville on the same day along with contract papers and fees($350). My Question is "What are my chances of getting Work Permit? " . My application for permanent residence is also in process in Buffalo. Is there anyone who has experienced this kind of situation? Quorax, Seniors and other members of this forum please reply,,,

Nil, you waited more than 90 days to apply for restoration with the LMO and work permit request. So you can expect a refusal and a direction to depart Canada.

Getting WP needs a +ve LMO, Check with a lawyer, I believe there should not be a problem

Did you read his post? His 90 days for restoration of status has passed. He is no longer eligible to apply for restoration and a work permit in Canada.
 
what if i apply after going to my hometown and apply from there with Positive Lmo and contract papers.....Do u think there should be any problem because i overstayed?
 
1) If TRV is valid you can legally stay in Canada
2) There should be a reason for your WP renewal
either ur employer wants u here
or some other valid reason to prove why you are needed in Canada like LMO

You can not simply apply for WP and get it approved after it has expired there needs to be a reason,
if 90 days is the only way to stay in Canada no one will go out of Canada if they make sure they renew WP application is filed with in 90 days

Was ur TRV valid or not during the overstay? There are many if's and buts here, consult a lawyer

No...My visa was expired in june 2011 too, later my employer applied for LMO in july 2011 which took almost 3 most to get it approved. Once i received the lmo, immediately i applied for work permit but not within 90 days ..... Also my Employer wrote an application to CIC that he had applied for the LMO in july and it took a while to get positive. Also stated he need me something like that. I dont know if that gonna work......Did anyone experience such kind of experience?
