Hi everyone,

Just wanted to know other people's thoughts on my case. I'm currently working with an immigration consultant since I feel I need professional help with regards to my situation.

Some background:

*I completed my studies in Food Technology in June 2015 and received my PGWP in October 2015. For some reason, the processing time was really long at the time. I decided to wait for my permit before I started working in my field. I finally got a permanent, full-time job in my industry in February 2016. Since then, I have worked for 2 different companies but for the same position, which has very similar job duties. The reason I switched because I was offered better compensation and it was much closer to home. I have worked continuously between the two jobs, literally having my last day on Friday and working the following Monday in my new position. Now that it's February, I have hit my one year mark and am working on my application package for PR under CEC.

*The interesting part about my case is that I also founded a start-up company back in December 2015. I have basically been working 2 jobs for over a year now, and it has started to take its toll on my health. And quite frankly, the company I've been working for has been undergoing through a lot of changes, most of which aren't good. Lately, I have been feeling the need to quit my other job and go full-time on my start-up. I am aware that self-employment does not count (unless for a start-up visa, which we are not qualified for), hence, I decided to put up with the long hours for over a year in order to get my PR as soon as I can.

My consultant calculated my points and I'm currently at 502. My NOC code is 2211, skill type B. Luckily, my CELPIP results and educational background helped me secure more points. I'm just waiting for the results of my ECA, which should be in in 2 weeks. Soon after, we will create my EE profile and wait for an ITA.

Would like to ask you guys:

  • How long will it take to receive an ITA from the moment you create your EE profile?
  • I have all my pay stubs, offer letter, employment contract and tax form from my 1st industry job (I was there for 4 months). Do I still need to ask a reference letter from them? My employment contract basically outlines my duties, salary and benefits and is written on a company letter head.
  • I also have all my documentation from my current employer, including a reference letter. Do you think it's "safe" for me to resign before I get my ITA? Is it required that I hold my current position during the application period? I would like to give my current employer an early notice so I can help them find a good replacement.

1. Comparing the current trend (please be aware this can change from draw to draw) with your 502 points, you should get an ITA on the very first draw that occurs after you submit your EE profile.

2. If you can get a reference letter that is the best way to go. If you cannot, then write a covering letter explaining why you are not able to submit the reference letter with all the other documentation you have (like paystubs.....)

3. You do not have to stick to your current position.

Yes, you need a letter of reference - it is the single most important document. The difference is that the letter of reference attests to the work you actually performed. The offer letter/contract are written before you actually do it - you only need those if you CANNOT get the letter of reference and are asking IRCC accept alternative proof. You can do the latter if you have explanation and evidence that your former employer refused to give you the letter of reference.

No, it is not required that you remain employed. Just keep in mind that IRCC will use the date at the top of the letter as your "end date" in calculating your work experience. As long as the letter was written AFTER you completed the one year, it really doesn't matter, but ideally, you would get an updated letter before you apply. But if the date is BEFORE you completed the one year, then it is essential to either get an updated letter, or to write a letter of explanation and submit alternative documentation about your ongoing work experience/actual end date (e.g. recemt paystubs, letter of resignation).

What if I have a CRA record of employment from my first job? Im not confident they will give me a reference letter mow, which is why I want to find alternatives.

You still have to try to get the reference letter. IRCC will consider alternative documentation, but only if you provide evidence that you tried to get the letter and could not.

The ROE is a very useful document to have in your case. But it still does not provide testimony about what you actually did, whether you performed the duties of a skilled NOC.

hey..I have a friend with a similar situation. How did your application go? Can you be sure that a current employment is not necessary for application? Requesting reply soon :)
