I am doing this for us :) And yes Filipinos are great They are real and just down right lovely people :) Specially when you find your match :) If every one had the hearts of the Filipinos life would be a better place. And befor anyone bites my head off. I think every country has its good and bad :) I will expect a few mangos thrown at my head and a few tasteful words in Tagalog but its all loving im sure lol

Hi,

I have the same case. I quitted yesterday, it's urgent and did not give 1 week notice. My employer said she will call the CIC, maybe because of cancelling my work permit (is that possible? what are the cons and pros of cancelling this). Am I still allowed to stay in canada even if my work permit was already cancelled and for how long?

Also, Im getting married this July and my husband-to-be is suggesting to have me the open work permit instead. Is this process faster and advisable rather than getting a new LMO.

Really confuse. Please help me.

No one can cancel your work permit, not even the employer and no one can send you home. Would have been better if you gave a notice.
Which means you can stay in Canada for as long as your work permit is valid.
Why did you quite the job without notice anyways? If you did not like working there, the employer can not do anything about you leaving. You can read about this in the HRSDC website, stating what the rights of a foreign/temporary workers are as well as the employers rights.

If you are just getting married this July, He can sponsor you right after you get the marriage certificate and all other requirements done. and you can include an open work permit application. BUT be aware that cic will only process the OWP application once you Sponsorship/PR application has reached or finished PHASE 1 which is also called approval in principle. It will take approx 6-8 months from the time they have received your application keeping in mind that everything was complete. If you can find an employer with an LMO it only takes a month to process a WP now a days based on processing times. but then again that will only be a closed work permit.

Thanks for the reply! I did gave a resignation letter yesterday but it's immediate (i'll not go to work today).
My reason is the location of my job. It took me 2hrs to get to my store (which sometimes I'm late) and I'm always putted on a closing shift which I can go home by midnight and it's unsafe to walk in the night. I told my supervisor about the danger I might get but he told me it's also dangerous for the boys and he also said that when I was hired I said I did told them my availability (but I didn't expect that I'll be putted in a far store).

My employer called me and said she will call the CIC because I didn't finish my contract. If by chance she cancelled my WP, obviously it will not be valid anymore, how long can I stay in canada to find a new lmo?

What is the phase 1? My fiancé haven't done anything yet about the filing of PR. He just got promoted as a manager and got his skilled work permit this January 2013.

Spousal sponsorship has 2 parts. It's different for Inland versus Outland, but both have Stage 1 and Stage 2. Inland Stage 1 is a preliminary background check for both people. Stage 2 is more in-depth and genuine relationship proofs.

Depending on his NOC code, you can try for a spousal open work permit as soon as you get your marriage certificate. TFW that work NOC codes A, B, or 0 (he will probably be in 0 for manager) can get their spouse OWP. You can keep it while his FSW application (Or PNP, CEC, whatever he does) is in process as long as you follow the guidelines. (And he has a work permit with a skilled job.)

Now, once he gets his PR and lands, your OWP is invalid. You do need to stop working. You can resume working once you get the OWP for Inland Sponsorship, unless your employer will get a LMO for you. Then you're fine as long as you have a closed WP on the LMO.

There is a lot of info in my post and I know it's kind of confusing - too much at once :) Get married and see if he can sponsor you for a spouse open work permit for right now. He'll need a copy of his work permit, your marriage certificate, and a job letter (outlining his duties and pay), plus the forms and fees normally needed for a work permit. You use the same application as you did before, just write "Spouse open work permit" when it asks for employer or LMO info.

The Employer CAN NOT cancel a work permit. Once it issued no one can do anything about it. Unless maybe you did something illegal but you did not. You were simply not happy with that employer and there is nothing she can do about that.

Don't be afraid.

The employer can't cancel your work permit. The worst they can do is complain to CIC. However, no one can force you to work. End of story.

If you feel it's necessary, you can include a letter to CIC about why you felt the need to quit that job. I wouldn't stress about it too much.

Only giving 1 week notice is poor taste. You may have trouble getting a reference from that employer in the future. However, there are situations that happen... I once gave less than 1 week notice because my employer was doing illegal activities and I was scared to work there anymore.

What the issue is - your employer is angry. It takes a lot of time to get the LMO, wait for the work permit, etc. It costs more to hire a TFW than a Canadian citizen or PR (sometimes significantly more). They are unhappy you let them down. That turns into anger - anger is a secondary emotion and springs from other emotions. However, that is their problem.

No it is not illegal, Amikety is right its just a matter of what they are feeling anger and frustration for all the paper work they did and you just quit the job like that, but there is nothing they can do about it.

Don't stress about it, if moving on is what you want then start looking for a new employer. Don't look back don't worry.

The only reason to worry is if you did something illegal to get your work permit. If you committed fraud, then CIC may investigate. If you were honest and followed the rules, then don't stress about it. The complaints will fall on deaf ears.

You can only file for a OWP if you meet the conditions for a OWP.

If you are concerned about your previous WP and employer when you apply for another CLOSED work permit, you can include a letter explaining why you quit (you didn't feel safe). For an OWP based on your spouse's work permit or Inland Sponsorship, you don't need to explain it, in my opinion, but you can if you like. (The OWP isn't employer based - that's why I don't feel you'd need a letter.)
