Questions about the Spousal sponsorship

Hi All,

My wife and I are currently living and working in Germany. I am a German citizen and my wife is Canadian. Before we get kids we want to move to BC because we decided that we want to raise our kids in Canada. While filling out all the required forms we had some questions which I hope someone can answer since we have not received an answer from the visa office yet and we really want to apply for my wife to sponsor me as soon as possible.

1) In the sponsor evaluation it asks for a data when my wife plans on moving back to Canada. The correct answer would be "As soon as my husband receives a visa/PR". However we have to give a date. Can we just give a date in the near future? Lets say April 2014? What happens if the processing takes longer and my wife hasn't moved back to Canada and the stated date passes?

2) In the sponsor evaluation form it asks for my wife to prove that she wants to move back to Canada? Possible answers are "Job offer", "Rental" etc. However we do not want to rent an apartment since we do not know when the processing will be finished? The same accounts for jobs. My wife does not want to move back earlier. As soon as I get a visa we will quit our jobs in Germany and move to Canada.

3) Some forms ask for the current country of residence or current employer. In those forms you have to give the time "From" and "To". Do we just leave the "To" fields empty for our current country and employer?

4) As a supporting document it asks for an Option-C printout from my wife as well as a letter from her employer to prove that she is employed. Since we are living abroad in Germany does my wife still has to request such an Option-C printout or is a letter from her current employer stating her monthly salary enough?

You ask the questions which puzzle many if not most applicants for sponsorship. Many of the problems arise because you want to complete the forms on line. Some of them are unanswerable on line because of the impossibility of giving the detail they ask for. In your circumstances you will have to consider filling the forms as best you can manually (you can copy the forms from the internet, fill them up so far as possible on your computer and then print them out, adding any missing bits in ink), attaching explanatory notes and sending them off by mail or courier. My advice is as follows: 1. Write into the form at the appropriate place a cross-reference to an attached note, heading the note with as much information as you can including dates of birth so that it has no chance of getting detached and lost. In the note state simply that you wish to live in BC and raise your future children there and will move there together once the principal applicant (yourself) is granted permanent residency. In your circumstances it is not possible to give a precise date. 2. Again provide a cross reference and a note stating that your wife has her origins in BC and wishes to return there with you to live and raise a family. Mention that her parents and siblings live there, if that is the case; also that until PR is granted you cannot arrange accommodation or jobs but that that will be done immediately your PR is granted. 3. Again a cross reference and a note is required: you cannot provide an end date at present. 4. Since you both live in Germany outside the jurisdiction of the Canadian revenue you cannot provide an Option C printout. I live in the UK and provided a notice of assessment for the latest tax year from HM Customs and Revenue, which appears to have satisfied CIC. I suggest you provide the German equivalent for your wife; but a letter from her employer would do no harm.

Hi! We have same case. My husband wrote that he plans to move back Feb 2013 but since the processing is longer than what we have expected, we decided that he stays with me throughout the process and that he will move back to Canada with me. They're Canadians hence they are allowed to live outside of Canada so I think there's nothing wrong with that.. I hope so.. (oh God! ::)) This seems to be a big proof of a genuine relationship, Am I right? ;)

Does your wife still have relatives and/or friends in Canada? They can write her a letter stating that you and your wife intend to move back and re-establish in Canada. It's not necessary to have a rental agreement or a job offer, she can submit a copy of a job hunting online or much better if she can have an employer stating that she will be given a job once she's back in Canada. Her relatives or friends can also help her as long as they are willing to by them allowing you and your wife to have their address as your address in Canada and that they will provide you a temporary home(I meant their home) to stay until you're settled.

Just write "PRESENT" legibly as you cannot type it there. :)

There is no minimum income required for spousal sponsorship. If possible, she can request for her latest Option C printout and attach a letter explaining that she is working outside Canada since date and so that is the latest Option C she can provide. If none, just explain why.

Thank you very much for your help. I guess writing an additional note is all we can do. We will see if that is enough or if they will require additional information from us.

I have another question about the whole process. If we would move to Canada (I would enter the country as a visitor) and then start the spousal sponsorship process for my immigration inland would I be able to get a temporary work permit and stay while my immigration is being processed?

We would like to move to Canada as soon as possible but I do not want to move there and not being able to work for as long as the process inland may take.

In my opinion, you can move to Canada considering youre from a visa exempt country but I suggest that you should apply outland despite being in Canada cause you cannot work until youve been granted a permanent residency and cannot travel abroad when youre applying inland.
Please correct me if Im wrong..

Thanks for the information.

Does anyone know how soon after the PR visa is granted one has to move to Canada? Since I have to give my employer a three month notice I am wondering if Canada will allow me enough time such that I do not have to quit my job before the processing is done.

If you come to Canada and apply inland, you can file an OWP (open work application) with the rest of your paperwork, so when your wife is approved to sponsor you, you will also receive a work permit and you can remain here while your application continues to process, however, the current estimated processing time for AIP (sponsor approval) is 10 months. So you would not be able to work for a minimum of 10 months once your application has been received in Vegreville.

If you file an OUTLAND application, you will not / can not receive an open work permit and will be unable to work until you have been granted your PR, even if you come to Canada to live while you wait for it.

In either direction, you can both choose to come to Canada to live while you await your application. Depending on how you apply will determine your wait times for ability to work. There are pros and cons for both applications, so you should weigh them with your wife to decide which approach is best.

Thank you very much. We will definitely apply Outland. Not working for 10 month is not an option. I can't imagine sitting around for 10 month not being able to work. Since we both have jobs in Germany right now we will just wait for the process to be finished and move afterwards. Although my wife would love to move back tomorrow ;)

In case I do not have more than three month to move once the PR visa is granted can I travel to Canada immigrate and leave the country again after a few days until everything is in order in Germany? To keep the PR I just have to be living in Canada for 2 out of the last 5 years? Correct?

Yes you can enter Canada as immigrant then be back in Germany afterwards but it seems to be scary without having the PR card with you which you will need upon entering back Canada. I'm not sure if the issuance of the PR card takes only 2 months. I heard that it's hard to mail the PR card outside Canada, they're very strict in that matter. The validity of your visa is the same as the validity of your medical which means you must be in Canada before your medical expires. I suggest you do your medical after you have completed filling out the application forms and requirements so that you will have a longer preparation time before you migrate.
