Hello,

I have a few questions regarding the processes involved in eventually taking my family back to Canada to live. I have spent much time on the relevant citizenship and immigration websites and am struggling to find answers to all of my questions.

My situation is as follows:

I was born in Canada and am therefore a Canadian Citizen. My mother & father live in Canada and are Canadian Citizens. They both are originally from England and I therefore have a British Passport (Dual Citizenship). I have been living and working in the United Kingdom for 15 years. I married my Irish wife in 2007. We have a 2 year old daughter who was born in England and a 2 month old son who was also born in England.

I understand that my daughter & son are considered Canadian Citizens due to the fact that I am a Canadian Citizen. I would like to get Canadian Passports for them. Do I first need to apply for Proof of Citizenship for them then use that proof to apply for Canadian Passports for them?

If this process is correct then I understand that my children would be sorted getting into Canada with their passports. All that I would then have to do is sponsor my wife in the Family Class, Spouse Catagory?

Also, how long do we have to move to Canada once my wife has received her permanent residency?, ie - before the offer of permanent residency expires.

Hi,

For Child passport application
Children born outside Canada to a Canadian parent require a Certificate of Canadian Citizenship.

The following documents must be submitted in addition to an Application for a Citizenship Certificate from Outside Canada:

a notarized copy of a document proving that one or both of the parents was a Canadian citizen when the child was born (citizenship card or Canadian birth certificate);
each parent should submit a notarized copy of one piece of valid personal identification (i.e. a passport, driver's license...); and
original birth certificate of the child which lists the parents (issued by government authorities in the country where the child was born), with an official and certified translation into English or French- where applicable.

Regarding the validity of PR visa for your wife, it should be before completion of ONE YEAR from the date of her medical examination.

Hi, we are in a similar situation and I wonder if anybody can help clarify. My husband is a Canadian citizen and I am an Australian citizen. We live in Australia with our young son who was born in Australia. I understand that our son has a right to citizenship but we are currently in the process of applying to immigrate with my husband as the sponsor. In the guide for completing the sponsorship application it states that it may not be possible to sponsor my son as he is automatically a citizen. We don't have citizenship papers for my son so can we still apply for for permanent residency for him instead and sort out the citizenship later? Any help is greatly appreciated.

No, you can not apply for permanent residency for him since he is already a citizen. The process you have to follow for your son is to contact the Canadian embassy, see http://www.cic.gc.ca/english/information/offices/missions/sydney.asp and ask them about applying for a citizenship certificate for your son. The application forms you need, you can find here: http://www.cic.gc.ca/english/information/applications/certif.asp

The processing time is very long but if you ask to expedite based on your plans to move to Canada in the near future, there have been some people who have gotten the citizenship cards within 2 months instead of in a year+. It is also possible once you have applied for the citizenship card, even though you don't have it yet, to get a temporary passport for the child at the embassy.

Hi Leon..actually I do have one more question that I hope you could answer for me. Can we still go ahead and apply for permanent residence with my husband as the sponsor at the same time as we apply for my son's citizenship papers? Or do we need to wait until we get his citizenship first? Thank you in advance.

You can apply at the same time because they are not connected to each other at all.
