Question regarding re-enter in canada on visitor visa

I have visitor visa right now i am in Canada. I got visa in USA when I am on student visa. I Didn’t complete my study in USA. I also misrepresentation ban on study visa from canada in year 2017 after that I don’t how canada gave me a visitor visa because i know that i have 5 year ban if right now i go to india and come back in May on my brother’s convocation then can I come back?? Please let me know if right now i travel to india then safe for me can i come back to Canada

First of all plz explain your queries properly cuz how you described it's really hard to understand wot you trying to say. But still i tried my best to understand your situation. If am not wrong it seems you went to states for study & you knew it that you can't finish study then you applied Canada visitor visa from there & without finishing your course you landed here. Might be it was your personal decision or someone misguided you bout Canadian immigration laws. Anyways if you are ban here for study permit in Canada but living as a visitor from last more than 6 months or the more then that time which you declared at airport or border during your landing then it's a offense if you didn't go back.

Furthermore if am not wrong if the situation is like that which i mentioned above then you gonna face problems during your return doesn't matter it's convocation or wot it is. Cuz CBSA officers have full right to deny entry for anyone of someone tried to manipulate laws. For more details from other ppl too plz explain your situation in details way. Tnx

I got misrepresentation ban on my study visa 2017. Then I went USA for study and in 2019 i came to canada on visitor visa and i didn’t finish my study in USA. Now my question is that if i go to india now then can i come back on my brother’s convocation without any problems?

So in which month / date you came to Canada as a visitor in 2019 ?

2. Did you declare bout your stay when you landed in Canada from States as a Visitor ? Like for how long you gonna stay here ?

1) i landed in canada on 31 dec 2019
2) I just tell them i will stay 15 or 20 days and i got stamp on passport in which they mention i will stay upto 30 jun 2020

See even they gave you permission for 5 or 6 months but your statement was only for max 20 days which is in their system. It was good if you could go back within those 20 days.

Those officers has too much experience & many steps ahead than us. Very straight forward with you if you try to re enter it's gonna be lots of questioning and on the other side you didn"t finish your study in States and manipulates with laws there too. Then you have ban for Canada study visa which is still on. Totally depend on officer if it's your good day might be your in otherwise uno this thing already you messed up your case urself. TBH with you i work at YYZ & now a days they are very strict. Take advice from other ppl too for better option cuz everyone has their own opinion. Good luck

I got it you showed them your education docs but you shouldn't forget that you declared your stay only for 3 weeks and now you have no intention to go to states and finish your study. Once you ll re enter they gonna find out each & everything just with your passport number.

So now it will risk for me if i went to india?? Because one day i have to go back to my country. Right now i am stayed with my brother he was facing mental problems so that’s why i stayed in canada?? Please gave me advice now what i have to do?

Hope your brother get well soon but Honey as i said it's good when you come for visit to any country always go back within your declared time period to keep record clear. I wish there shouldn't be any problem but it's totally depend on officer. Am not trying to afraid you but you have doubt & uno too bout your profile which isn't good. Still i would recommend wait & at least seek advice from different ppl. Other side if you don't go till stamp date then it's totally illegal doesn't matter for how long you do have visa. For re entry you can try but 110 % you have to officer convince in case if there is any tuff officer & it's totally depend on him / her they wanna you give exit or not.

Well assuming you actually had a 5 year ban for misrepresentation then you should not have been issued a visitor visa so either you did not get a ban registered in the system or somehow made it through by mistake. Was your visit visa issued before you failed with the study permit or after if the latter then sounds as though you have misrepresented twice once for the study and once for the TRV. ?

Also even assuming you have a valid multiple entry visa nobody here of course can predict what might or might happen should you leave and try to come back. You could find that your ban if it actually was a ban comes to light the next time you try to enter and then be refused entry or as per 12/2019 you are allowed back in for a temporary period. Whatever the outcome it is generally recommended as a visitor to be out of the country for an equal amount of time as having been in the country. Just because in 12/2019 your passport was stamped 6/2020 does not mean you have a free pass to enter the country again.
