Question regarding PR renewal of my family hope to get reply soon :)

Dear Sir/Madam

MY father, my mother and my younger brother got their PR in 2007 august then they were out of Canada till September 2010

So, basically they have been out of Canada for more than 1095 days

Now the thing is they came in September 2010 stayed for 5 months then went out of Canada again

Finally they came back to Canada in 2012 March and three of them are residing in Canada now with expired PR Card

So for fulfilling the 730 days obligation they will be filling it in October 15 2013

So when October 15 2013 arrives shall they apply for their PR renewal having the 730 day obligation filled ??

Cause they want their PR card they are worried that they have been out of Canada for 1095 days in the 1st 3 yrs 2007-2010 will this be the cause of PR renewal denial ?

To play safe, I suggest your family to continue living in Canada (don't come and go) and apply your renewal in April 2014.

They might want to give it a few more days before they apply like November 2013 maybe. They might want to send all the proof they have of their stays in Canada like tax records, employment records etc. Plus boarding cards / flight tickets etc. If they were not doing anything in Canada for the 5 months they stayed in 2010, they would have a hard time proving that stay so in that case, they may want to wait to renew until March 2014 when they have a 2 full years.

Immigration sometimes does a residency questionnaire on people if they do not believe they really stayed 730 days in the past 5 years. Some red flags that immigration might see that would cause them to do that would be for example if they have little proof of having been in Canada for the time they say they have and if they apply being very close to the 730 day limit.

If they get a residency questionnaire, their renewal will take much longer and they will be asked to attend an interview where they must provide documents to prove their stay.

They can not lose their PR because of anything that happened more than 5 years ago. Immigration can only look at the past 5 years when they examine their cases. They are not allowed to go further back.

Bro thanks a lot for your reply just wanna know 1 more thing like when they apply for the PR renewal do they send all the tax slips boarding pass everything wat u said with the pr application form all together the 1st time altogether right ?

Yes, better to send it all together right away and hope to get a quick renewal than to hold back and end up with a delayed application.

Thanks bro the point is I think they have lost their boarding passes even I lost mine but we all have the rental receipts , tax returns at that time will these two work ? Guess what we just got the CBSA travel history few days back and in there its noted that there was a passage entry to vancouver so shall we give the photocopy of all the travel history ? And we have health records like medical investigation reports and vancouver health cards so will that work as well :) ?

Yes, give all the evidence you have and get a new travel history before you apply so you can cover the time from now and until the day you apply. Make photocopies of the passports, all pages, and write on the margins which stamp fits each trip.
