Question Regarding My PR Application about Marital Status

Here's the thing, I entered the pool on March 19, 2019 and received ITA on March 20, 2019, and then I found out that the application asks me for my spouse's info, I had checked "married" in the marital status option and selected my spouse not accompanying me to Canada, I thought at the time that it meant that my spouse will never accompany me to Canada, at all, and only to find out from this forum that "unaccompanying spouse" could mean that the spouse will still come at a later time. The real thing is that me and my spouse separated a very long time ago, I refer to my spouse as my spouse only because technically we're still married but we actually filed for annulment the day we separated with each other, it's been in process for more than a year now, so what should I do? should I decline the ITA and modify my profile from married to legally separated? the application is asking me for my spouse's police certificates, medical report and passport uploads, there's no way i can get these things, in fact I'm not petitioning her to Canadian PR ever, period, can i maybe upload blank pages to my wife's portions and submit the application?

Yes decline your ita and apply as legally separated. There is no way u can get around this thing

or a letter that explains the situation?
No I don’t think it will work this way. U either can be married in that case u need to provide her docs, or legally separated on that case documents that proves separation or divorced in tgat case divorce certificate.

Trust me on this one I have gone thru same thing. As much as I didn’t ’t want to divorce my wife, I had to make this decision because when all efforts from my side were failed to reconcile and she didn’t want to remained in the marriage I divorced her becuz my ielts was expiring and remain married means I couldn’t get her docs. So I ended up divorcing her and later apply as a divorcee

with exactly what documents can i prove legal separation? in the US you need a court order for that, or can i just provide enough docs that can prove the Canadian version of "legal separation"'s fine? do I still need a court order to prove the Canadian version of "legal separation"? or just annulment filing papers are enough?

That buddy I can’t answer what constitute a legal separation in US. U need to talk to a lawyer about that

i just found out that i dont need to decline my ITA i can just hit modify family info button on the top and change my marital status from married and unaccompanying spouse to legally separated, after all my spouse did not help with any points that counted towards my ita

But remember they compare data of pre ita and post ita. So if they ask make sure u have an explanation ready
why did u think it's easier to decline my ITA and modify my EE profile to "legally separated" and then wait for another ITA when I can just hit the modify family info button to modify my family info from married to legally separated and then offer them the explanation for the differences between pre ita and post ita IF, they ask? obviously at the time of pre-ita i didn't understand the differences of definitions of "legal separation" between US and Canada, and as I mentioned in my question, the only reason I put married in the marital status option is that I'm still technically married to my spouse and are not "legally separated" in the US, but apparently "legally separated" has a different meaning in Canada where a court order is not required to prove it I suppose, bottom line I think is as long as I make clear to the Canadian immigration authorities that divorced or not, I'm never petitioning my wife to Canadian PR, they'll understand.
