I am new to this forum and it has been very informative. I am in the last stages of this Canadian immigration process. I did medicals last November 2010. It is almost March and no word from the NY VO. I have sent like 3 case specific inquiry with no reply. I used a lawyer (Campbell Cohen) and their office tells me they haven't received any communication either.
I am a Registered Nurse(BSN) in the US, still working even though im not supposed to (been outta status for 8 yrs).
I am starting to get worried because I just read some topics that mentioned the VO does background checks for status in the US etc. I have been out of status for almost 8 yrs now and I have 2 little boys. I came as a student, fell out of status, got married and now divorced (never got the US PR) and has been hiding since then. I never received any deportation letter probably because I have been moving around a lot.

Do any of you think that is a reason why PPR is taking so long?
Do any of you think the US immigration will deport me due to this background check?

I am worried because I have two boys below age 5 and do you think its best to just leave if this process starts to drag. I haven't been home in 10 yrs.

My advice, stop sending e-mails because that will annoy CHC. You got medicals you are almost there so wait patiently. If there is a security check and you get rejected you will know then. Wait and pray, but stop sending unnecesary e-mails because it might even seem suspicious. Leave it to your immigration lawyer.
 
Look. I would rather think and be positive. Not much you can do.

I know that if you are living in a country other than you country of birth you are suppose to update the visa office with you current status in that country, how did you do then?

If you have been out of status for 8 years.

Since you are at your last stay then you just have to pray.

Probably you are being delayed due to the security checks. Don't worry that you will get deported from US due to this reason. I don't think , CIC will inform US authorities that they found you are an overstayer and should be deported. It is quite normal that people are waiting 4 to 6 months or even more after medical. To find out exact reason for the delay you may have to get your CAIPS. But it will take a month or more after you request for it and in the mean time you may get a passport request. Therefore, just wait and see.

1. R u really with Cohens*? 'Coz they ought to have updated u with your queries. Nonetheless, pls spk to their Legal Asst 'directly'.

2. Yes, I think so. Your security clearance is tough to come... fast enough.

Do any of you think the US immigration will deport me due to this background check?
3. Yes. If & when they come to know your actual whereabouts... u'd then be 'served'.

Your background check post got me really worried about the US immigration thing. I also think, not sure, I have been emailing the wrong VO. I don't know which one has my case.
But then I read ur info on background check , and that got me really worried (maybe I should pack my kids and bag).

I am really praying no one comes knocking on my door cos I know they will separate me and the kids cos they r US citizens. Campbell told me I will get the PR but never said anything about them checking my status.

They'd touchbase all authorities - enquiring on u... their reports could be long to come by... that'd 'delay' your s/check considerably.
BTW, I see that u weren't asked another 'fresh' FBI Report - pray that it doesn't happen. 'Coz that could bring ppl knocking your door!

I guess even praying will not save you from the immigration office.

I feel like they gonna get you sooner or later...

Don't you think they would have done all that before medicals? My FBI report showed nothing on it.

Usually Police Report or FBI report don't refer to your status in a country. It is concerned with your criminal state whether good or bad.

I would calm down if I were you. You are nearly there. God that has helped you does far will continue to back and protect you. Don't harass the VO just as everyone have advised you.

You are not a state threat in any form!
