question on name discrepancies

My name on my birth certificate and passport doesnt match up:

this is how I can show it -

on my birth certificate: John Kelly Smith III (Kelly is maiden name)

on my passpoort: John Kelly III, Smith

apparently there is no maiden name in this country where I have become a citizen about 15 years ago, so my maiden name and the III have all become part of my name now. So its just basically Name, Surname.

Do I need to have an affidavit explaning this when I file my PR app?

Hi. It really depends on what your visa office requires you to do. I have a misspelled middle name too, on my birth certificate. But my visa office only requires that I submit an affidavit to explain the discrepancies.

Thanks!

But when you read the forms, it says write your name (as how it appears on your passport). So if I do that, then my application name is the same as the passport. So no problem, yes?

Now, when they look at my birth certificate, they may get confused.

Yes, I bet they would be. But I think as long as you include your VO's requirement for name discrepancies, I think you should be good.

Wait a minute, hold the train here. How can Kelly be your maiden name? First thing, men don't 'normally' have a maiden name, and even if you did, how could you possible have a married name to follow on your birth certificate? You were born married?

Now, if you mean 'Middle' name, that makes much more sense, since you are a III that implies you are 3rd generation, presumably named after your father and grandfather. So, with that being said, to have the III following the middle name (Kelly) is not uncommon on a passport of other identification. It is just a suffix and is always indicated after the middle name but before the last name on official documents, with exception of the birth certificate as you well know.

All people coming from this country where I am don't use middle names. So no middle names on every passport.

No, wouldn't need to explain why you have a middle name while others in that country don't. I think those without a middle name would have a harder time explaining why they didn't include one of the application! LOL

As I said, your name is actually set up first, middle, last, suffix. That is how you would enter it on your application. When is says exactly as it appears on your passport or identity document they don't mean to write it in the order that is actually presented on your passport, they mean, fill in their corresponding boxes with the same identical information that is on your passport. Make sense?

NO midde name!

So on the application, I will have to put on the Name: John Kelly III

No you don't. You still have one first name, one middle name, one last name (surname) one suffix. Your name is John Kelly Smith III. (I know, not your actual name) That is what you will put on your application. Stop over thinking it as that only leads to second guessing yourself, and usually the first instinct is the correct one.

Passports don't show middle names. They show given names. So if my name is Tommy Lee Jones with Lee as a middle name, my given names are Tommy Lee and my last is Jones.
