Question on Immigration and Citizenship Status

Hello,

I am writing here about a question in Citizenship Application particularly related to Immigration and Citizenship held previously. I have previous history of residence in the USA. Which I have listed in all the applications give to IRCC thus far.

So, the problem is I was on working in the USA and extension petition was denied so I had to return back which I have provided to IRCC in background questions. However, in previous applications specifically work permit, I listed this travel in previous country of residence and provided with status as 'worker' for the entire stay.

Now looking at this similar question , I feel like I should split this as 'worker' until the day my extension was denied and enter 'other' with 'out of status' for the period until I left the status. it was like 10 days until i could finalize everything and leave the country for good. Can anyone tell me if there is any problem here?

Also, I wanted to add that this entire duration is not in the eligibility period. Opinion from any expert on this question will help as this is the only question I seeking some second thoughts.

Hey All,

I don't know if this is a complex ask or I am complicating it myself. I tried to search this forum for a related question like this I could see few cases where there were mentions about completely forgetting to add a citizenship in PR application or in few other cases it has been mentioned that they haven't included visitor visas or another visas as the question only calls for residency or citizenship status. but this post from dpenabil clarified a lot. Like he said, IRCC is looking for honest response based on individuals ability to understand the question and present it with the information he has.

Answering my own question, at the time of my work permit applications, I couldn't have thought about this technical status like 'out of status' or 'implied status' etc as I was still learning through the immigration and its process. if I remember correctly, PR application had asked only for the purpose of travel which is quite different than the actual status in the country. Now, I would definitely go with what I said at first in the post. I could only feel there isn't a problem but that's where my knowledge stops.

if at all @dpenabill , @scylla , @rajkamalmohanram and other experts go through this question i would like to see if they have anything more to add.

Speaking personally, I still don't understand what actually happened.

In general terms for IRCC, if something is in doubt or was/is unclear, write a SIMPLE, CLEAR, and BRIEF explanation of what happened and what your status was. Ideally with something like a simple and clear timeline with dates.

If you do that simply and truthfully, you're unlikely to have issues.

Thank you @armoured . As I explained in the first post, The issue here is even though I have declared my denial notices to IRCC in previous applications. I didn't show the status change appropriately. For example I listed my duration as in from X start date to Z end as 'worker' in the USA in previous work permit application. But now in citizenship application I would like to split and show this duration. like from X start date to Y end date as 'worker' and Y start date to Z end dates as 'out of status' which is like around 10 days. I hope it is clear now.

You misunderstood me in one specific sense: I don;t actually care what it is you were trying to say. I was saying: explain it clearly (in the sense of 'better than you did above') to IRCC - they care. (And their opinion on these things matters, and mine, bluntly, doesn't).

The fact that you misstated it earlier means that you should include a (short) explanation that on a previous application your presentation of the facts was mistaken (and, ummm, sorry). While it's not ideal, mistakes do happen, and coming clean before the people who care might catch it is the better approach, particularly when it's arguably a technicality.*

*Better compared to something worse, such as, for example, a stupid and mendacious approach such as lying about something that may not be that important.
