Application to Sponsor, Sponsorship Agreement and Undertaking (IMM 1344)

Question 1:
Check one box to indicate how you wish to proceed if you do not meet the sponsorship requirements.

If you check the box to withdraw your sponsorship application then
the sponsorship application will not be processed. All fees will be refunded, except for the $75 sponsorship fee.
If you check the box to proceed with the application for permanent residence then
the sponsorship application will be refused. None of the fees will be refunded.
********

My question: what's the meaning to proceed the application if the sponsor can not meet the requirement? If the sponsor does not meet the requirement, then the permanent resident application for the sponsored family will be rejected , right?

Yes it would, I personally would click not proceed, so all founds will be refunded.

if you check to proceed with the application even if the sponsor is refused, they'll continue with the permanent residency application, but it's pointless - all your money remains with CIC and the PR will be refused eventually as well.

as Kev1n said, check the box to withdraw your application if you're deemed ineligible to sponsor - you get most of your fees back, except the 75 C$ used for processing the sponsorship application.

Thus, why does CIC design the form with that "option" ?



Besides, I would like to ask that can we apply to cancel the application if it has been started?

i honestly have no idea why there's that option available . i think the principal applicant can file an appeal in his favour afterwards, not sure.

scooby, you can withdraw your application whenever you want, doesn't matter at what stage it is.

scooby, you can withdraw your application whenever you want, doesn't matter at what stage it is.
And to add to this....you will get all money back except for the 75.00 if you cancel at any stage before the Visa is issued. Once the visa is issued you will not get back any money however you can still cancel.

I would like to interject here.

I agree that it would seem a waste of time on the face of it but you have a decision to make.

Looking at the accompanying guide, it states:

Note: Check “proceed with the application for permanent residence” if you submit an undertaking of assistance to support the permanent residence application of a family member or close relative on Humanitarian and compassionate considerations.
If you fit that criteria, you might get through but it would be a 'skin of your teeth' situation and it's a lot of money to risk, too.

But to conclude: not worth the risk. just have it back, look it over and reapply.

The option is there for people who know they will not be approved to be a sponsor (which means the PR visa will not be issued), but they think they can win on appeal - perhaps because of humanitarian and compassionate reasons. Generally, it is quicker to just say you do not want to proceed if found ineligible to sponsor, get everything back, correct whatever the problem was, and apply again. Appeals can take years.
