question about visitor VISA extension 5708

Hello everyone,

I have a question about the extension of the Visitor VISA. I am from Germany and have a 6 month Visitor VISA (stamp in passport) which will expire May 19th 2014. I am in the process of filling out the form IMM5708E (which should be the right one for me).

The question 3 in that form is a little bit confusing for me. Am I applying for a "restoration of temporary resident status as a visitor" or "extension of my temporary resident status"?

Also I don't know the indication of my stay is allowed to be. I am currently applying for PR and don't know how long this will take, why I can't say how long I need my extension to be. Could somebody help me how to properly answer these questions.

Without having the experience of applying for an extension yet, here are my thoughts:

1 - I think you would be applying for this one - "restoration of temporary resident status as a visitor". To me the other option suggests you are extending a TRV (temporary resident visa), not a visitor's visa. Both are different. TRVs i believe are for people in canada to work or study, or needed to get special permission to enter after being found inadmissable. It would really depend on which pass you are currently in the country with. Did you get a paper stapled to your passport when you entered? If so, what does it say? If your passport was only stamped, then i would assume that means you are strictly on a visitor's pass.

2 - are options given for extension time? It could be safe to start with 6 mo, then apply for another extension if need be. Otherwise, i would ask for a year - though I would think this is a risky move.

I am looking forward to answers provided from people with experience with this because i will need to be doing this when i return to canada this summer!

Restoration doesn't apply in this case. Restoration is only used when your stay has exceeded the allowed duration of your visa / length of stay granted at the border, AND you are within 90 days of that date being exceed, AND you want to apply to restore (i.e. get back) your status in Canada so that your status is no longer overstay/illegal. Restoration also involves paying an additional fee. Again, doesn't apply here unless the OP has remained in Canada longer than allowed and is now out of status.

@rhcohen2014: yes, I have a stamp in my passport which is the visitor VISA for Germany.

So am I applying then for "Extension of my temporary resident status"?

I know that the "application to remain in Canada as a temporary resident permit holder" is exactly the same (IMM 5708E) as the one for extend my stay as a visitor.

So would it be the smartest to "ask" for another 6 months?

if you are in canada on a visitor pass, then yes, i would think you would want to apply for a visa extension - i believe that's technically what a visitor pass is. if you apply for the wrong thing, they will return your application.
