Question about travelling outside Canada on Student Visa

Hi,

Firstly, thank u guys on helping everyone with their doubts and questions..u guys are doing a great job.

My work permit was to expire on 2 Jan 2013 and inorder to extend my stay in Canada I decided to go back to school after my work permit expires.Therefore I got a offer letter for January 2013 intake and also got my study permit and student visa respectively. However since CIC started the open bridging work permit for applicants who have applied for PR, I applied for the open bridging work permit, since I have applied for PR and received my AOR. Therefore, I withdrew my application from the college and now I am waiting for my work permit to get processed.

My question is would it be a problem to come back to Canada, if I want to travel to my home country for 6 weeks and come back on a student visa, and if till then my work permit is not processed? Would the officials at the airport wonder that how come I am on a student visa and travelling, when technically I should be in school.

I hope I have been able to explain my situation.Replies would be appreciated. Thanks

You will be asked for sure, where do you go to school, etc. And you don't go to school so you have no reason to travel to Canada. Even if your work permit is processed, you don't have your work permit with you so that won't help you (unless somebody sends you the work permit to your home country). Even with the work permit in your hands your situation will still be confusing to the immigration officer:
- Student Visa
- Work Permit
- no job
- no school
This is risky. Your situation would be much better if you had your work permit and a job (with a letter from your employer proving you are employed). Even then you will be questioned because you have a student visa but you are not going to Canada for school. I would say, don't leave Canada until you get your PR.

If you really need to go home I would say you have two choices:
1) Don't come back until you get your PR. Let CIC know you have changed your address.
2) Register for a full-time school program which starts around the time you are planning to come back. Make sure you have the document from the school proving you are registered + the letter from your bank/sponsor showing you have enough funds for the program and living expenses. Then you can come back as a student with a student visa + study permit + proof of acceptance at a school.

The best you can do is call CIC and ask what they will advise you in your situation.
