Question About Refusal

hi!

I’m hoping this is just me getting the jitters! (I’m also a naturally anxious person anyway) but I’m wondering how often Spousal Sponsorship gets denied/refused?

For background, we’re doing Inland, he’s a Canadian Citizen and I’m a UK Citizen and we have no dependents. We met and dated in 2018 while I was here on my IEC and I briefly returned to the UK before coming back to Canada to marry him in March 2019 and start our Inland app. We had a wedding in Ottawa at City Hall and friends and family from both sides attended.

I’m concerned on two points really. One is that until March 2019 he was on welfare. He’s now got a job and, as required by the checklist, he’s providing a letter from his current employer. He’s also been honest about his work history on the relevant forms. Because he’s only recently started work we’re also erring on the side of caution and providing a financial plan and a letter from his mother stating that, should the need arise, she would be able to support us. (We don’t intend to use her money). I’m also applying for an OWP and my previous employer from IEC has said they’ll rehire me if they have vacancies.

My second point of concern is that before my IEC expired I stupidly applied for an OWP not knowing I wasn’t eligible. Again, I have been honest about this refusal on the form which asks if you’ve ever been refused a visa.

Obviously my relationship with my husband is 100% genuine and we have nothing to hide so I’m hoping I’m just really over-thinking the situation.

How often are sponsors denied? Or how often is PR denied in general in Spousal cases?

The welfare won’t matter as he’s currently got a job. The guide clearly states:

You can become a sponsor if you are:

• able to prove that you are not receiving social assistance for reasons other than a disability

He’s employed and not earning social assistance, and can prove this.

With regards to the OWP, so long as you’ve stated it on your form and have been truthful then you’re good to go.

All in all, yours looks like a straightforward case. You’re married, which was attended by family and friends and I’m assuming you provided pictures of the event. Even if you didn’t provide many they may ask at a later date for more pictures of your wedding ceremony as an additional document request.

I can't speak to your specific situation, so I'm sorry if this isnt very helpful. But I just wanted to comment and say I think you're overthinking just a tad. You've been totally upfront and honest on your applications, you did your best to prove that your spouse can financially support you. They may ask for more information or documentation if they're concerned your relationship isnt genuine or if they're concerned about your financials, but from what I've seen they're pretty fair in their assessments and they give you whatever opportunity they can to prove that everything is on the up and up.

Sponsorship denial, as I understand it, is pretty rare. I'm certain that as long as he isn't on welfare at the time of submitting the application, his previously being on welfare isn't going to get him rejected. There's no minimum income requirement for spousal sponsorship, so as long as he has a letter from his current employer, as well as the one from his mum, you should have enough to satisfy that he has the means to support you. I also suspect you're probably being over-cautious about the OWP thing. Did they give you a formal rejection, or just sent the paperwork back? Either way, I don't know that it'll be too much of a problem since it wasn't like you were rejected on the basis of being inadmissible to Canada or something like that. And as long as you are up front about it all, you're doing your due diligence there. I don't know if there are any stats about rejection/denial of PR, but from the sounds of it I don't think you'll really have many issues. Just provide all the evidence they request with the application, if your relationship is genuine you should be fine! If they feel like they need some extra info, they'll request it. But you should be fine. Good luck!

Don’t think you have anything to worry about if your husband continues working. Hopefully he was not unemployed for years and only started working after you got married. It wouldn’t necessarily mean he will be denied but there may be more concern. That is why it will be important for him to maintain employment throughout the process.

Spousal sponsorship denial isn't rare at all, it happens quite often actually. But as OP's situation, I do agree she is a bit of overthinking. Although it isn't written in any field guide lines, but CIC usually treat first class western country applicants quite easy, comparing with the treatment received by applicants from other third world countries. Usually, applicants are from first class western country applicants only needs to provide enough evidences to prove the genuine of their relationship is good enough to get approved, and applicants from other third world countries also needs to convince CIC that the sponsorship isn't for the sole purpose to secure an immigration VISA.

Looks fine. As the welfare was so recent, I suggest your partner contact the provincial welfare authority to make sure that he is off of their list. There have been instances in the past where sponsors were no longer receiving welfare but were still listed with the province, which resulted in sponsor refusal.

Yeah I was talking about the sponsor being denied rather than the whole application, I didn't word it that clearly.

If you want to apply again, you need to be able to overcome the resons why the first application was refused.

You have no rights to appeal if you applied inland. So reapplying is the only option.
