I have question regarding my Wills, (last will and testament, medical/living will, and special power of attorney) do i need to have it Notarized here in Canada or would it be okay if i get it notarized it in the Philippines? Will Canada honor it? My partner lives in the Philippines and we will be applying for outland conjugal application very soon.


I have another concern, are we eligible for conjugal application considering with the time line we have:

Jan 2014- met online, we had serious online relationship for a year
Jan 2015 - i visited my partner for the first time, i stayed for 2 months. Relationship and communication still continues. We have proof of bank accts, properties, etc.
Oct 2015- my partner was declined trv in canada and usa
Jan 2016- will be my second visitand will stay for 3 months.

Considering we have all the evidences and proofs. will the immigration count those times we chatted online or do they start to count when i first visited my partner. Please advice. Thank you.

In Canada a will does not have to be notarized to be legal, but it needs to be witnessed.

If you both can travel, why can't you just travel to another country to get married? I know I've read of other people on here doing that. You will have a much easier time than if you try for conjugal.

We did tried getting married to USA but she was denied by a visa. My partner is a transgender from Philippines where no same sex is allowed.

Could try somewhere else where gay marriage is legal.

Will our case makes it easier? I thought they treated spouse, common law and conjugal equally? Aside from monetary expense, its hard for her to get a tourist visa in other countries, we tried usa and it failed.

Will the immigration consider our relationship online? Or will they start counting form the first day i visited my partner?

It says on the website atleast 1 year in a relationship, we met online jan of 2014 then i visited her for the first time last jan of 2015. By jan 2016 onwards we are technically 2 years but 1 year since i last visited her.

Please note i will be with my partner in jan 2016. So by that time we have seen twice already. Are we eligible for conjugal? I want to make sure i understand it correctly as it will take 18 months to process the conjugal application. Please help

In general a married application is easier to prove. Conjugal is the most difficult of all of them. Yes the requirement is 1 year, but you have to be able to prove all of the obstacles and restrictions preventing you from a married or common-law relationship, in addition to demonstrating that your relationship is genuine. Conjugal exists as kind of a last resort, for people who have no way to get married or live together.

I'd look at it this way. If she is denied another visa from another country, that will only help your conjugal application. If she's approved then you can get married.

I know I read on here someone in your situation were successful getting married in New Zealand. I don't know how strict CIC is about this, but if they see you have money they may question why you didn't try getting married somewhere else.

I was told that conjugal application was designed for opposite and same sex couple that cant get married due to barrier. My partner is a transgender woman.
