Hi all, we sent off my husbands pr and owp and are still awaiting the AOR.
His visitors status expires at the end of March, if we haven't gotten the AOR by the time he has to leave, does he still get implied status or would he have to leave the country?
 
If he was in status when his application was sent then he should be fine on implied status. Be aware that if you are only relying on that and for some reason they return his OWP application (wrong fees, wrong form, etc etc) he will then have lost his implied status.

It would be well advised to go ahead and apply for a visitor extension to combat that potential issue at the end of February. So long as you and he can show shared funds and proof that you have submitted the PR application there should be no issues with having it extended.

Of course, if you are absolutely certain that all fees were paid properly and all forms were correct on his OWP then you have nothing to worry about.

Thank you, so if we wanted to apply to extend his stay to be safe, sending it at the end of February gives us enough time?
 
Yes, you should apply 30 days before the current one expires. That will give him implied status at a minimum until the visitor extension is finalized. He would then be all set until that visitor extension either A: expired or B: he receives his OWP.

Then that's what we will probably do, thanks for the advice!
 
Is there a way that if OWP is approved and Visitor visa extension is in progress - will they refund the fees for extension application as this is no longer required?

That would depend on how quickly you were able to withdraw the extension application after you've received the OWP and whether or not they have begun processing. Since a withdrawal request usually takes about 6 - 8 weeks to process, I suspect you'd not have time to get it before it began processing but you could certainly try.

I would wait until a few days before his status expires to apply for an extension, as that gives more time to potentially be able to get a refund if you withdraw when the OWP arrives.

I'm not so concerned about getting a refund, my main worry is keeping him in status. If he were to ever accidentally be out of status, what would happen? Would his owp and pr app be denied?

It doesn't matter when you apply for an extension as long as the current status is still valid when you submit. It currently takes about 4 months to process a visitor extension, so if he applies at the end of March, he will have valid status until at least July, regardless of what happens with the OWP. On the off chance that the OWP app is returned while he is on Implied Status AND his visitor extension is refused in July, he would be out of status. He could then apply for Restoration of Status, which would likely be approved.

I wanna know because my visitor visa will expire this month Mar 25.. though i belong to implied status now? Is that mean they already process my OWP or maybe still will have problem of my apply
I read there people suggestion to extension visitor visa but what if I already got AOR1 and also connection online?

Would appreciate any help from you guys.

Right now, you have visitor status. When that expires on the 25th, you will have Implied Status while waiting for the OWP to be processed.

No one can guarantee that the OWP won't be returned, even after AOR.

Do you have any idea if I apply vistor visa is that refundable ? Could I just withdraw online if I got my OWP before they extension my vistor visa, thanks
