Question about Implied Status -> Post Graduate Work Permit Transition

Hi there,

I am posting this on behalf of my girlfriend and we would both love some clarification if possible on her current situation

Some basic information:
1) Girlfriend recently graduated from a two-year hospitality management program from an accredited college.
2) Study permit expires at the end of July
3) Off campus work permit (OCWP) expires at the end of July

Timeline of events:
1) In early May, my girlfriend applied for the Post Graduate Work Permit (PGWP) with an expected processing time of 62 days (early July)
2) Today, my girlfriend had an interview with the HR manager of a hotel who asked my girlfriend if she is eligible for the PGWP (which she is) and is wondering if my girlfriend is considered to be "Implied Status" if she doesn't receive the PGWP before the OCWP expires

My questions:
1) On the off-chance that she does not get the PGWP by the end of July, will she considered to be on "Implied Status"?
2) Will there be any implications to her working during this "Implied Status"? In addition, during this status, she can only work in accordance with the OCWP, correct?

Thank you so much in advance!

I tried to organize everything as clearly as possible.

From reading information on the CIC website and from a few topics on here, I honestly think she will receive the PGWP in time, but even if not, her "Implied Status" should not cause any problems. However, she is very worried about it and I just wanted to make a post on here since the CIC hotline is closed until tomorrow.

Thank you again!

Hi,

Yes she will be on implied status till a decision is made on her PGWP application. Meaning she can work full time after she is done with her studies. There is no reason for the PGWP to not go through! So don't worry, not even she will get it in time but she is eligible to work full time on her implied status.

I was more or less in the same situation and I made the HR of the hiring company to call CIC, and they confirmed it on the phone with them.

There is nothing to be worried about.

All the best,

Hi Rezafc,

Thank you so much for the reply.

It's good to hear from someone who was in the same situation before.

Hope you have a great week!

She won't be on implied status, she will need to go back home to her village in india and apply from there.

SIGH, this is not true. She can work until she receives a decision on her PGWP application.

http://www.cic.gc.ca/english/resources/tools/temp/students/post-grad.asp

"Note: Paragraph R186(w) allows students who have completed their program of study to work while they are waiting for a decision on their work permit application as long as they were a full-time student enrolled at a designated learning institution in a post-secondary academic, vocational or professional training program, and they did not exceed the allowable hours of work."
