Question about implied status...or any status (USA citizen).

Hi

I am a US citizen. We applied for sponsorship through my Canadian wife (inland app + OWP).
I am not entirely sure of my status currently in Canada, as they never gave me a stamp when I entered. I figured its a "visitor" , but US citizens do not require a visa.

I read somewhere that TRV/eTA doesn't apply to US citizens but unsure.

In any case... does anyone know how it works with US citizens? also a bit worried since it may affect OWP application....

We already recieved our AOR a month ago

Any help is greatly appreciated.

Hi

You were granted 6 months visitor status when you entered.

A TRV/eTA is just permission to board a commercial carrier to travel to Canada. It has nothing to do with status in Canada.

You will be a visitor until your 6 months is up. After that 6 months is up, you will have valid Implied Status while waiting for the OWP. When your OWP is approved, your status will be worker.

AOR and the OWP don't count for anything extra when entering Canada. Yes, people do it. However, there is always the risk of being refused re-entry.

Canuck is correct, however I want to stress that in the event you are refused entry, your application will be denied because one of the requirements for inland is that you remain in Canada for the whole duration of the application. Unlikely that you'll be denied, but just wanted to make sure you knew the full extent of the situation!

It is a requirement of inland that you be living with your spouse IN Canada throughout the process. This is why IRCC advises people to apply outland if they are planning to leave Canada during the processing.

I am living with my partner in Canada...but as as US citizen travelling to the US to visit my family for 2 days, is it really a requirement for me to stay dormant , no matter what happens? lol

If you do end up getting refused at the border though, your application is considered to be abandoned. It may be unlikely for you to be refused, but this is still a possibility.

You are free to leave Canada whenever you want. However, as you do not have the right of entry, it is your personal decision whether to take the risk of being refused re-entry and rendering your inland app abandoned.
