Question about Departure Order

Hi everyone,

reading myself trough this great forum I found a few posts about Departure Order. Can pls anybody tell me, whats the difference between a `normal` refusal of an visa extension application and a Departure Order ? I could find out that a `normal` refusal of an visa extension can be fixed with a restoration of status application (in my case I would be within the 90 days and I would already have submitted my spousal inland PR application). Is it very common that CIC issues a Departure Order or does it more apply to visitors that are out of status ? thank you for any answers.

A normal refusal means u have the right to apply for restoration within 90 days. A departure order means that they send u a refusal letter which says also that u have to leave Canada in 30 days. There is no restoration.

You can submit a restoration application provided you do this within 90 days of being refused (yes - this applies to visitor visas).

Did you submit your PR application before your visitor visa expired?

thank you scylla, I will send my inland PR application at the end of this month, my visitor visa expired at the end of november and i sent in time a application for my visa extension (the decision should be here in around 2 weeks), cause of financially problems we only can submit the pr application this month, otherwise we would`ve sent it earlier :( I yet did not received a decision on my visa extension application and now I`m under implied status. As said above, I been reading a lot trough this great forum and I read a few posts about departure orders and am now a bit worried if I also could face one. I am from a visa exempt country. Is it very common for CIC issuing a departure order ? thank you.

They may issue departure orders when a refugee case is denied. In my case they issued a departure order after the officer interviewed me for work permit extension, and was not satisfied that i would leave the country after work permit will be expired

thank you svetlana for your answer. I think I should stop making myself scared for nothing since I`m still under implied status and just waiting for the outcome of my visa extension (which in worst case hopefully is `only` a normal refusal which I can fix with the restoration of status, since I`m within the 90 days and by then I have already my pending inland pr application sent. But as I said, I read (a lot) myself trough the topics here and some are really scary.
