Question about "adaptability" factor in PR application

I am in the process of completing my PR related documents (skilled class) and send it over to Buffalo office for processing. However, i have a question. My brother in law and sister are Permanant Residents of Canada. However, at this point of time, they are not living in Canada and are in their native country temporarily. They intend to return to Canada very soon. Does the PR application require that the relatives should be physically in Canada at the time of application or not?

I obviously don't want to furnish any wrong information. I would really appreciate your responses.

Yep, they have to be there. So if you're short of points, maybe it would be a good idea to wait until they move back.

In that case, it looks like I won't be able to use the adaptability factor. Does that impact the processing of PR application? One of my colleagues told me some time back that if one has relatives in Canada, that helps in speeding up the PR application.

I also have one more question. the PR kit asks to submit reference letters from all the previous employers.

I have gotton into some stupid argument with one of my x-employers and now he refuses to give me a reference letter. i do have an experience letter from him which is a year old. i also have my offer letter and salary slips etc.
would it be a big deal if i can't furnish an up-to-date refernce letter from my employer?

The adaptability factor doesn't have any impact on how fast they process your application. It only adds points.

Submit what you have - it sounds like it'll be fine. What you're trying to establish is your qualifications as a skilled worker - not your ability to get along with every past employer. You could also contact HR if it's a big-enough company and get the information that way.

Thanks so much. That gave me some confidence.
As far as my previous employer is concerned, he is a small fish with only 20 people. So there is no hope there. But like you said, i can definitly prove my experience with him. so i guess that should be fine as well.

Could i ask you one last thing? How exactly do Canada consulate checks whether my relatives are physically in Canada at the time of application as my sis and bro-in-law still pay Canadian taxes. it is just that because of some family obligations, they had to go out of the country for about a year or so..they may be coming back later this year.

and as far as point are concerned, i am exactly at the passing marks criteria without that adaptability factor. so no worries on that front.
