Query: I have an Open Work Permit but I received TRV showing visa type as a Visitor visa.

Hi,

I did my master's degree in Canada and completed it in 2020. I applied for my open work permit from within Canada and received it in January 2021. After receiving my open work permit, I applied for a temporary resident visa (TRV) in February 2021 from within Canada. I got my passport stamped in August 2021. But my visa classification shows visitor (V1) with multiple entries. All my friends who applied at the same time got worker (W1) stamped in their passports. I am still in Canada.

1. Will the visa classification affect my work permit status?
2. Is it possible to get the TRV visa classification changed by raising a separate request? I doubt that because there is no separate category while applying for TRV (only options are Visitor or Transit). Please correct me if I am wrong.
3. My understanding is that a TRV is required only to enter the Country whereas my open work document defines my eligibility to work and current residency status in Canada. Even though my visa says visitor but my residency status is that of a worker due to my open work permit. Therefore, I can continue to live and work in Canada until my work permit expires or I travel outside Canada. Is my understanding correct?
4. If I travel outside Canada for a certain duration (weeks or months), can I enter again with my visitor visa (TRV) and open work permit document? If permitted can I continue working with my current employer? This is my main query.

Hi, I have also been stamped a V-1 instead of W-1. I have submitted a webform regarding it. I’ll update here if I hear back from them.

I spoke to ircc and they told that it should not make any difference. Keep your work permit with you while you travel to prove your worker status in Canada. Also we shall stay in Canada until the expiry of our work permit.

Is the validity way beyond your PGWP validity ? Some people are getting it way beyond upto the expiry date of their passport. They could be promoting tourism by issuing such TRV's. Many don't convert to PR, yet want to stay longer/ visit family/friends etc.

You can work until your PGWP expires. But you could use the TRV for future visits to Canada as a visitor. I am assuming this TRV is issued way beyond your PGWP's expiry date.

TRV is just to enter the country. The work permit lets you work after you are processed by the CBSA officer at the airport/border. Travel to the US, and some islands don't require a TRV to re-enter.

Did they issue you a visitors visa with a validity beyond that of your PGWP ?

I know that people on visitors visa can get a work permit(Covid rule), so they would just want to issue visitor visas but people with work permit will be allowed to work/ considered workers.

In a way, its a good thing if you want to re-visit Canada in the future(if PR doesn't work out). I say all this assuming the TRV is issued way beyond the validity of your PGWP.

Is the validity beyond that of the PGWP ?

Don't worry. This is a good thing. Even after your PGWP expires, you can always come back as a visitor. Of course the border officer will determine entry. But you basically have a visit visa. PGWP lets you work. TRV lets you sit on the plane and present yourself to the officer.

Can you please confirm if the validity is beyond the PGWP ? Otherwise there's no advantage.

I think they are promoting tourism. lol. Canada needs money.

Yes, your understanding is correct. The TRV is valid until the passport's expiration date.
