Hi,

I am a born citizen of Québec in Canada and my (future) wife is a born citizen of Minas Gerais in Brazil. She has one dependant child of 2 years old from a previous relationship. We plan to marry this summer in Brazil and I have all the information on how to marry in Brazil and register the marriage in Québec. I am starting to look about all the documents I will need to fill for the sponsorship (because I want to fill this with her when I will be in Brazil) and I have many questions. Since I am from Québec and she is from Brazil, I think all the following documents need to be filled before I send my outland application to CPC-M.

Sponsor
=======
IMM 5491Document Checklist
IMM 1344AApplication to Sponsor and Undertaking
IMM 5540Sponsor Questionnaire
IMM 5401Receipt

Spouse
======
IMM 0008 GenericApplication for Permanent Residence
IMM 0008 Schedule 1Background / Declaration form
IMM 5490Spouse / Partner questionnaire
IMM 5406Additional Family Information
IMM 3908Latin America

I have a few general questions and a few questions about specific parts of each documents.

General Questions
===============
1. Did I miss any documents in the above list?
2. Do I need to send the documents that are not applicable for Québec with the mention "NOT APPLICABLE - QUEBEC RESIDENT"?
I read this somewhere in these forums if I remember correctly.
3. When I mail my application to CPC-M, how do I need to organize my documents?
For example, do I need to staple each document individually? Do I need to isolate all the photos? Should I send everything in a box? Should I staple additionnal sheet used for answer in the middle or at the end of the documents? etc...
4. Do I need to include a prepaid return envelope or something similar?

IMM 5491 (Document Checklist)
==========================
5. Should I check the box of documents that are not needed for Québec application?
6. Since the documents of my wife will be in Portuguese, I will need a "certified" english translation(as mentionned in the top of the document). Where can I get this?
7. For the #21, does the son of my wife count as an "Adopted children" if he immigrate with her in Canada?

IMM 1344A (Application to Sponsor and Undertaking)
===========================================
8. For the question #9 in Section A, does my current marriage count as "previously been married"?
9. For the question #10 in Section A, do I count as a "Permanent Resident"?
10. For the question #6 in Section C, should I skip b) and c) if the address in a) is the same as her address of nationality?
I am unsure because I want to apply outland.

IMM 5540 (Sponsor Questionnaire)
============================
11. For the question #5, what number should I write if it took me 4 years to finish 3 years worth of college?
12. For the question #7, should I write a fixed date or "NOW" for the end date of my current job?
13. For the question #8, does a visit of 3 months as a "tourist" (not working) count as if I was a resident of another country?
I am very unsure of this question because I want to show that I visited my girlfriend but I would like to write my birth date for the question #11.
14. For the question #9, what should I answer knowing that I am a born citizen?
15. For the question #17, does my current marriage count as "ever been married before"?

Story of my wife
=============
My wife had a previous relationship that lasted a few years. They never lived together but they had a child together. Almost one year after the child was born, her ex-boyfriend ended the relationship and they had a verbal agreement about the money he would have to give for his son. She is taking care of her son 58 days out of 60. As you can see, there is no documents to prove the relationship started or ended.

IMM 0008 Generic (Application for Permanent Residence)
==============================================
16. For the question #10, does her current marriage with me count as "previously been married" or does her relation with her ex-boyfriend count as "previously been in a common-law relationship"?
17. Does she need to put the photos on the application or only in the envelope?

IMM 0008 Schedule 1 (Background / Declaration form)
============================================
18. For the question #11 and #15, should she write a fixed date or "NOW" for the end date of her current activity/address?

IMM 5490 (Spouse / Partner questionnaire)
===================================
19. For the question #27, does my visit of 1 month and my other visit of 3 months count as "lived together"?

IMM 3908 (Latin America)
=====================
20. Where do I get the "accurate translation" they are asking for?
21. Do I need to send the checklist for her documents(Appendix A)?
22. How do I classify her documents?
For example, do I put it seperated from my documents? Do I put all of the documents in the checklist in the "Appendix A" section? etc...
23. For the #8, should I include a copy(and the traduction) of the marriage certificate issued by Brazil or a copy of the marriage certificate from Québec after the registration of my marriage(or both)?
24. For the #8, does my wife need some kind of paper or letter that says she is not with he ex-boyfriend anymore?
See "Story of my wife" for more information
25. For the #9, what are the paper she needs for her child knowing her situation?
26. For the #15, Does the 8 photos they ask include the photos on the "IMM 0008 Generic"?

Supplement to Schedule 1 - Background / Declaration
===========================================
27. Does her relation with her ex-boyfriend count as "previously been in a common-law relationship"?
28. If yes, what documentary evidence can she include to support her claims knowing her situation?
See "Story of my wife" for more information
29. If no, what does she write to the question about "child resulting from this previous common-law relationship"?

Declaration from non-accompanying parent/guardian for minors immigrating to Canada
=======================================================================
30. They say to send that paper to the Canadian Embassy/Consulate with a photocopy of a valid identity document. Does she need to do this or only include that with my application?
31. Does she really need to send (to the embassy or with my application) a photocopy of an identity document of her ex-boyfriend?
32. If yes, what is a "valid identity document"?
It might be very hard to get.

I will try to answer the most possible question i can !!! you have so many :p

2- i only send the document that are for QC citizen and wife receive PPR 2 week go so i think you don't have to send all others documents with a mention "not apply for QC"

3- you can place like you think, i place like this, another place in other way... place your form for it be EASY for the IO to read, understand it easily.
I place my document in one enveloppe, another envellope for the form of my wife, another folder for proof of relashionship and i use 10 small envellope for the picture for distic all moment of our life.

4- NO

5- i make a X only for the form i need.

6- You can make it with a certified translator in Quebec, you need one from the " Ordre des traducteurs, terminologues et interprètes agréés du Québec (OTTIAQ)"
you can find one at this web site : ottiaq(DOT)org

It's more expensive to make it in QC but is legal, you can make it in Brazil for cheaper i think but is more long as you need to make it legalise after the traduction by the external ministor from brazil.

7- NO is a dependent child of your wife.

8- NO is your first marriage, if you are married before, this is your previous marriage.

9- You are citizen of Canada .... so NO your are not a PR

20- see answer in question 6

21- YES

23- copy and the translation of the ORIGINAL certificat marriage from brazil

24- YES it will help, and better is to have a lawer make it and sign by both your wife and is ex-boyfriend.

25- a letter from the father saiyng that he don't have any objection that his child will immigrate in Canada...

30- all send this with the complet application to Mississauga

31- Identity card from Brazil, passport !!!

You are not a resident if you are a tourist. By definition, a tourist lives somwhere else.

Your current marriage is not a previous marriage.

In order it to be considered a common law relationship, the two people must live together continuously for at least one year. If they never lived together, it was not a "relationship" for the purposes of this form. Having a child is irrelevant to this definition. If you became the father of the child through marrying his or her mother, that is not an "adoption" either.
