You can apply for BOWP but you will not be able to start working again until it's approved (or you become PR, whichever comes sooner). Also, I suggest consulting with a lawyer, sometimes IRCC might actually ask you to leave Canada if you are out of status to proceed with your PR application.

Hello,

Now I am not sure if I applied through A73 LMIA exempt work permit... I am not really aware of this terminology.

This is what the letter says:

Persons wishing to obtain or extend a work permit in Canada must satisfy an Officer that they:
• have complied with all conditions imposed on their entry;
• will leave Canada by the end of the period authorized for their stay;
• are not in a category of persons inadmissible to Canada under the Immigration and
Refugee Protection Act; and
• are able to perform the duties and otherwise meet the requirements of the job.
Based on careful review of the information and documentation supporting your application, I am
not satisfied that you meet the requirements of the Immigration and Refugee Protection Act and
Regulations.


Any idea?
It's hard to say if we don't know which work permit you applied to. Did this work permit require a valid CSQ and a job offer?

Hello,

I applied for a closed work permit based on an LMIA exemption due to CUSMA, and I applied 1 month before my PGWP expired. My PGWP expired on Sept 6th.

I had a meeting today and I will have another tomorrow with a consultant. I'll try to call IRCC as well... My main worry is that this rejection will affect my PR process, according to the consultant, it shouldn't but still waiting for some legal advice.

You should have explained this in your question...

This is the requirement for CUSMA. I assume you haven't met the requirment.
  • The job offer is covered by an international agreement like CUSMA, which is the successor to NAFTA
  • The job is for a CUSMA Intra-Company Transferee, who must:
    • Have worked for the US or Mexican employer for at least one of the last three years
    • Be employed by the company at the time of application
    • Work in a managerial, executive, or specialized knowledge capacity
  • The job is for a CUSMA Trader, who must:
    • Demonstrate an intention to carry out substantial trade between Canada and their country of citizenship
    • Have an employing company that is of American or Mexican nationality

- I don't think this will affect your PR process. However, you might need to leave Canada to complete the process. Check with IRCC; they will guide you. Also, try applying for a BOWP so that you can stay. However, they might reject it if you haven’t maintained your status in Canada.

Hello everyone,

I’m encountering an issue while completing my permanent residency application, and I’m hoping someone here might have faced a similar problem or could offer advice.
• Some forms require me to input my name in both English and Arabic.
• However, the name fields in these forms are automatically populated with information from my profile on the application portal, and these fields cannot be manually edited.


• When I tried to update my profile to include my name in Arabic, the system rejected the change, stating that the information must be in English only.

As a result, I am unable to provide my name in Arabic as requested in certain forms.

Has anyone experienced a similar issue? If so, how did you resolve it?

Double check if you are even eligible for restoration. You have 90 days since your status expired. The refusal letter will tell you if you can restore your status to worker or not.

Btw, do you know if it is ok to wait outside Canada for the response of both processes? (PR and restoration/BOWP). At this moment, it does not make much sense for me to wait for the responses here if I am not allowed to work...

Waiting for PR outside of canada: yes, but you need to inform IRCC if your change of address.

Hello. My application was returned due to IMM5406 I did not mention my children below 18years, sincerely I thought we only add those who are 18 and above.
Do I need to pay again everything?? Since the fees paid were not returned to me. I fear that if i use the receipt used before it will be returned again. Please advise.

You need to pay again.

Your previous payment will be refunded but it can take up to 8 weeks. You can also request a refund here: https://ircc.canada.ca/english/information/fees/refund.asp

then it has just been stuck in this step for 2 months now.

After I applied my case, I tried to search for anything that could let me know the time for the procession, and I found this website from the Government of Canada

I keep track of the expect process time from this site. but I do not know the information that it provides valuable for reference? or could find any processing time rules from this maybe?

That means the official expected time is not that valuable for reference. But how do I know my VO and the officer who is checking my profile? because my case is not really complex. I never travelled to another country, had no crime record, and stayed in Canada for a long time. should process fast but the fact is the case is stagnant.
