PWGP and EE Questions

Hi Everyone,

I will really appreciate your help with a question regarding the EE questions.

I worked under a Post-Graduation Work Permit in a qualifying job offer for over a year, and I am filling out an Express Entry Profile.
My PWGP does not have an employer named on it, and I have been working with LMIA exception code C43 (post-secondary graduate)

Some questions for Express Entry imply that my work permit has an employer named on it, and they do not have an "N/A" option to select.

These question are:

"Is Chris's job offer from the employer named on the current work permit?"
Available answers: "yes/no"

"Has Christian been working full-time for the employer on their current work permit for at least one year?"
Available answers: "yes/no"

"Was a positive Labour Market Impact Assessment (LMIA) issued for the current work permit?"
Available answers: "yes/no"
"No - My work permit is excempt for an LMIA due to international agreement"
"No - My work permit is excempt for an LMIA due to a Federal-Provincial agreement"
"No - My work permit is excempt for an LMIA for other reason and is employer-specific" (note " and is employer-specific")

Could you please guide me as to what do I need to answer on this question? None of them apply to me but this option is not available, and I dont have an LMIA for "other reason" but my permit is not employer-specific.11

Thank you OMG_Chakromakro. I just went back to the application and the second question doesn't actually say "any":
"Has Chris been working full-time for the employer on their current work permit for at least one year? (Or for an equal amount of part time work?)"

I was thinking that reply a plain "no" will only flag my job as a non qualifying, and the answers wouldn't really be accurate.

Besides they included the option to be and LMIA except, but they added the "and is employer specific" while mine work permit is except for an exception code and is open permit.

Could you please expand a little on this?

I have the same problem. Have 1 year of Canadian exp, Open work permit and a job offer letter (NOC 2175). Called CIC but the agent told me to use the "Report a technical issue" tool and mention the issue, which I did.

You guys do not have a valid job offer.

The very first question should be "no" and you won't have to answer the rest of the question as they do not apply to you guys.

According to the CIC our job offers are valid. It doesn't need to have an LMIA nor being an employer specific work permit to be a valid offer:

"Generally, a valid offer is for a job that is:

full-time and non-seasonal,
for at least one year,
in a skilled job listed as Skill Type 0, or Skill Level A or B in the 2011 National Occupational Classification.

A job offer must be in writing, and must set out details of the job they are offering you, such as:

your pay and deductions
your job duties
conditions of employment, like your hours of work.

In most cases, a valid job offer must be supported by a Labour Market Impact Assessment (LMIA). The employer has to apply for one from Employment and Social Development Canada/Service Canada.

If they get a positive LMIA, they must give you a copy and a written job offer.

In some cases, your employer does not need an LMIA to support your job offer. Find out more about jobs that are exempt.

Under Express Entry, a valid job offer will give you additional points in the Comprehensive Ranking System."



If you click on the jobs that are exempt, you can find the exception code C43

I have submitted yesterday. The agent told me it will take around 10 days depending which department will it go to and number of requests they get. It can be earlier or max 10 days.

You are free to do as you please but be aware that you are mistaken. " A valid job offer will give you additional points" - This is not the case when working on a PGWP as you do not have a valid job offer.

If you answer those question incorrectly prepare to have placeholders for "letter of employment" and "job offer" when receiving your ITA.

From my understanding, any job under PGWP (which is a open work permit without specific employer), is NOT eligible for valid job offer points. Is this correct? Please correct if it's wrong and I will delete this reply ;)

Job offers under a PGWP are not valid job offers:

A valid job offer has to be:

made by one employer
for continuous, paid, full-time work (at least 30 hours a week),
for work that is:
for at least one year after we issue your permanent resident visa
not seasonal
not on a contract basis, and
in a job that is Skill Type 0, or Skill Levels A or B of the 2011 National Occupational Classification (NOC)

and either:

the employer making you the job offer has a new positive Labour Market Impact Assessment from Employment and Social Development Canada that approves the offer and names you and your position

or

you are currently working in Canada in a NOC 0, A or B job on a work permit that was issued based on a Labour Market Impact Assessment, and
you are working for an employer listed on your work permit,
you are authorized to work in Canada on the day you apply for a permanent resident visa, and when the visa is issued, and
your current employer made you an offer to give you a full-time job for at least one year if you are accepted as a permanent resident

or

you have a valid work permit for a NOC 0, A or B job that is exempt from needing an LMIA, and you:
are currently working for an employer specified on the work permit
have one year of full-time work experience (or an equal amount of part-time work) for that employer and
have a valid job offer from that employer for at least one year after we issue your permanent resident visa.

The answer to the first question that asks if you have a valid job offer should be no.

No my employer is not listed. On my profile, I answered yes to having a valid job offer because I have the document from my employer to upload. My job is full-time/permanent. However, I did not receive the 50 points so I believe whether you are unsure the system knows the difference, and will award the points based on how you answer the questions which follow.
