Public Intoxication Ticket in Charlottetown, PEI

My friend was put in a sober cell and released next day with “Being intoxicated in a public place ticket” of $250 under section (39)2 Liquor Control Act due to a misunderstanding. The officer who released him in the morning told him, this is more like a speeding ticket. He also mentioned it won’t appear on his criminal records.

He will apply for his PNP in the next couple of months, following with PR application once PNP is received! He is just little worried as it’s his first time with this.

Will this affect his PNP or PR application by any chance?

The ticket was issued under s.39(2) of what Act? It's not the Criminal Code.

This is provincial legislation and will not result in a criminal inadmissability.

That being said, if your "friend" is asked if he has ever been arrested, he would need to say yes and explain what for.

It should not. He wasn't really even arrested as much as he was detained for his own protection. He should just be ready to explain what happened and not hide it in applications to IRCC.

Was what written in the police report matter? If it does, he was thinking of requesting it to be accurate.
