PRTD and PR Renewal

We are a family of 4..(me, wife and 2 children)..we did our landing in August 2011 and recd our PR & SIN cards....we returned to our country of residence immediately (stayed 30 days)..now want to finally immigrate permanently....our PR cards expire in Oct 2016.

What will our status be when we apply for renewal in October 2016 or should we wait to complete 2 years of continuous stay in Canada and then apply for renewal?

Secondly my minor daughters PR card did not come bcos of photo issues….we have applied for her Permanent Resident Travel Document on 29/Dec/2015..but have not received it yet. .how long is the processing time for Permanent Resident Travel Document?

Please assist

It sounds like you don't meet residency obligation. Unless there is some severe medical issue involved that would present a H&C reason for not staying in Canada the past 5 years, you can expect CIC to revoke your PR status as soon as they learn you don't meet the RO. There is a good chance you will be reported at the border by CBSA when entering Canada, or even your daughter's PRTD app may trigger the investigation for them to begin cancelling all of your PR status.

Thanks Rob_TO - Yes there was a strong medical situation of my daughter due to which we were unable to continue our stay...and have now applied for her PRTD

Be prepared that if you are not investigated now, you may be when entering Canada. Bring proof of all the medical reasons for not meeting RO. So all doctors notes, hospital stays, etc covering the past several years that show it was impossible for you to return to Canada.

I'm not sure how CIC will view this as a true H&C reason, since your daughter is a PR she could have received all medical treatment in Canada.

Need your help with one query:

I landed as PR in March. However, that was a short landing (COPR expiring in April) as for organizational project commitments, I cannot completely relocate before May end.

While filling in the form for PRTD, should I add the reasoning under "Humanitarian and Compassionate Grounds" section? Or no explanation is needed? I intend to move for long in June.

As long as you are returning to Canada well within the first three years of the date you landed, there is no concern about compliance with the PR Residency Obligation. No need to explain any H&C reasons.

It is very common for new immigrants to complete their landing, given the limited time allowed in their PR visa or the CoPR, and very quickly leave Canada to return home to complete business or settle affairs. And then later come to Canada to settle. Technically the new immigrant has up to three years to do this, but of course most return within the first year.

No explanation is needed as you are not in violation of the residency obligation until you've been outside Canada 3 years.

Or alternatively, if you supplied an address in Canada to when you landed that your PR card will be mailed to, whoever receives it can courier it to you where you are now.
