PRRA and sponsorship???

Hi everyone!

Here's my situation:

My husband had an interview for pre removal on March 24,2014. They told him that he dan apply for PRRA. I sent the sponsorship application on December 1, 2013 but i don't think its still in process. Because on the CIC website the processing times for in-Canada applications says "working on applications received on July 8,2013." So we're planning to apply for PRRA so that we can save some time. And they said the decision will be made within 3-6 months.
My questions are;
-If we apply for PRRA will they wait for the sponsorship decision?
-If it doesn't get approved and he has to leave, can they transfer the in-land application to out-land?
-If not, if i apply for out-land sponsorship when he goes back home does he need an ARC still if the sponsorship gets approved?

Hi Svetlana! Thanks so much for your reply. My husband just wants to work this summer so we can save some money. That's why he's going to apply for PRRA. I guess we're just gonna have to wait and see. :(

Depend on the situation ..if u guys applied for PRRA may be they took years to made their final decision and its depend on case to case ...According to u they gonna take 3 to 6 months only but I am totally disagree with u Because I know one guy he claim PRRA Dec 2012 but till now he never heard any thing and CBSA asked him to show up in CBSA office in every 15 days once ...
If u guys FILED UR inland application also and u guys got ur AIP (FIRST STAGE APPROVAL) before getting 'yes or no" for ur PRRA ..then u guys gonna be safe and their got very high chances CBSA gonna wait until ur spousal application in process and until u get ur final decision about ur spousal application ... they just gonna ask u guys to show up every 15 days once in CBSA office...
Current time for inland first stage 8 to 9 months and its not accurate and always change time to time and depend on case to case also ...
Inland application can't change to out land application .... but u can withdraw ur application at any stage and can filed ur out land application any times
If he withdraw his PRRA then I don't think so he need to get ARC....Good luck and God bless all of us

Hi Harmin! Thanks for the reply.
So if he still applies for PRRA and gets denied and when they send him back will he need the ARC then? I really don't know how this ARC works. How do they determine the kind of removal order he will get? If the process is 8-9 months our 1st stage is probably going to come in August or September, I hope it comes before PRRA decision. That's weird how that guy didn't hear anything. Maybe they forgot him :)

Marvel, first why did he have a pre removal intreview..did he overstayed or denied refugee claim? if he ovesrtayed then he will be issued an exclusion order which means 1 year ban- after 1 year he wont need an ARC. If he gets deportation order he needs ARC in all cases

PRRA is the second face of refugee claim or u can say faster way to claim for residency in Canada ... If CBSA don't allow u to claim as a refugee then they will advise u to claim PRRA ..As i told u PRRA faster way to claim residency but its very risky also because once they denied ur PRRA then they straight way gonna issued ur removal orders BUT u still can appeal in federal court ..the paper given to u for sign ALSO PRE-REMOVAL RISK ASSESSMENT paper...HERE I AM PASTING FOR U FULL INFO ABOUT PRRA ..GOOD LUCK
Eligibility
An officer will determine whether you are eligible to apply for a pre-removal risk assessment (PRRA).

One year bar for certain refugee claimants and previous PRRA applicants

If you made a refugee claim or you previously applied for a PRRA and your application was rejected, abandoned or withdrawn, you may not apply for a PRRA unless at least 12 months have passed.

Note:

If you come from a designated country, you cannot apply for a PRRA until at least 36 months have passed since your refugee claim or PRRA application was rejected, abandoned or withdrawn.

Countries exempt from the one year bar

In the event of a sudden change in country conditions, certain nationals may not have to wait 12 months to apply for a PRRA. Regulations have been developed to specify criteria which must be considered when determining whether or not an exemption should be granted.

Other ineligible persons

You may not apply for a PRRA if you:

made a refugee claim that was determined to be ineligible for referral to the Immigration and Refugee Board because you came to came to Canada from a safe third country,
were found to be a Convention refugee in another country, to which you may return,
are a protected person (that is, you already have refugee protection in Canada),
are subject to extradition (extradition is a formal request that Canada return a person to another country because they are a suspected or convicted criminal).
How to apply
If you are eligible, you will be given an application form and guide. You will have fifteen (15) days to apply. If you receive the form and guide by mail, you will be given an additional seven (7) days.

At this time, your removal order will be suspended. This suspension will remain in effect until:

you notify Citizenship and Immigration Canada (CIC) that you do not intend to apply for a PRRA,
you miss the application deadline, or
you apply for a PRRA and your application is rejected (or you withdraw or abandon your application).
In support of your application, you can submit written evidence to help explain the risk that you would face if you leave Canada.

In reviewing your case, the officer will consider:

risk of persecution as defined in the Geneva Convention,
danger of torture, and
risk to your life or the risk that you may be subjected to cruel and unusual treatment or punishment.
Certain applications, such as those from persons who are inadmissible for serious criminality, are assessed only with respect to danger of torture and risk to life / risk of cruel and unusual treatment or punishment.

Note:

Remember, you are responsible for keeping your application up-to-date. If your circumstances change and this may affect your application, it is your responsibility to inform CIC of the change. Decision-makers need all the information that you want considered for your application.

After you apply
If your application is accepted

Most persons whose PRRA applications are accepted become ‘protected persons' who may apply to become a permanent resident.

If your application is rejected

Persons whose PRRA applications are rejected must leave Canada. Rejected applicants may apply to the Federal Court of Canada for a review of the PRRA officer's decision.

Hi guys!
I just got an email saying:


You have met the requirements for eligibility as a sponsor. The Application for Permanent Residence (APR) for your relative will be processed separately and he/she will be contacted shortly


Does this means this is AIP? He also got an email saying he's eligible to being sponsored.
