hey guys. Can anybody help me? In june 2012 i got refused for work permit and got a letter to leave canada. I hired a lawyer and he sent an application to restore my status as a visitor on 25th of september 2012. On 8th oj january 2013 i got married and filed the inland sponsorship on 14 th of february 2013. On 2 of april 2013 i got denied for restoration as a visitor and they issued an exclusion order( i showed to the officer the receipts that i sent the sponsorship application, even i brought a copy of the application). As long as i have an inland sponsorship CBSA gave me the forms to fill the PRRA and send it to Vancouver. how do you think..do i have any chance with the PRRA? or i should better go back home and file an outland application??? Thank you very much. me and my husband are very confused, we dont know what to do.

Only about 2-4% of PRRA get approved. so almost for sure it will get denied.

but did they say if you get approved for step 1 before u get denied for the prra are u allowed to stay in canada and wait out the rest of the process?

they said if something will ,,move'' in the application...im afraid that PRRA will come faster then my 1st stage approval will be approved and they will send me home..then it will be deportation order? thats why i dont know what to do...go home now/??

regardless if it came through before stage 1 sponsorship approval.
if u get an exclusion order it would be for 1 year i assume, so u wouldnt be able to apply outland for at least 1 year, unless u are willing to apply for an ARC (authorization to return to canada) as well. or if u try for the prra and get a deportation order, u will be able to apply outland and need to do the ARC.

so either way if u leave and want to apply right away to come back u will need the ARC.

how long has it been since u sent in ur app?
and how much longer do u have to send in the prra if u decide to ?

Hi,my PRRA was refused in July 2012 after 6 years, however, cbsa notified me of this in November but gave me a chance to apply for sponsorship and they'll wait for the first stage to be completed and if its,s approved then everything will be ok!-Knock on wood :D

i sent my application for sponsorship on 14th of febryary 2013. and the prra i have to sent till 24th of april 2013

Mrembo. how did they notify u? did u go for interview with them?

so with the average processing time at 6 months.
if you send it right before the deadline, you could still get approved before u get the prra answer.

I would say to go for it, apply for the prra right close to the end, just before the due date.

theres a good chance ur stage 1 will be approved before u get prra answer,

and if for some weird reason they make u leave anyways, u can always apply outland and come back, its not like ur out of options.

if i were u, i would go for it, cuz we didnt have the chance to so we had to get up and leave our life in vancouver and move to mexico, which was really hard and its been a hard year for us. so if my husband could have stayed in canada it would have made things so much easier!!

and like mrembo said, they were allowed to stay and wait for it, so theres a good chance u will get to stay too!
:)

thanks. how do u think..if they send me home for example after that...it will be deportation order???? i mean exclusion will turn in deportation?

are u in mexico now?

it will turn into a deportation yeah
we got a departure becomes deportation order

, it just means u have to apply for the ARC to come back to canada, so when u apply outland they will process ur application first than when they are ready to approve it, they will ask u for a $400 fee, and a letter stating why you should be allowed back into canada,

the average for mexico takes about 2 months to process the arc alone, but i have seen it happen in 2 weeks aswell.

so it does add a bit of time to ur application, but not too much.

what country are u from?

I was in mexico with my husband from march 2012-nov 2012. than he lost his job, so i came back here to work, and have been back ever since. I just went to visit him for 2 weeks in march though.

if u see my timeline, our arc is taking alot longer than average, because my husband was caught shoplifting in 2009 and had to do some community service to erase it from his record. so they wanted extra documents from us like a clean rcmp, and documents to prove he completed his community service.

im from Romania. what about if i leave now? now i have an exclusion order..maybe it will be easier to come back..how do u think?

so your husband is waiting for ARC?

They sent me a letter and I had to go to the local immigration office where they notified me of the decision,at first the officer said I had to appeal but after talking to someone there he told me not to but instead apply for sponsorship ASAP which I did!!-I guess I was lucky they gave me that choice :)-I believe since you've already applied, they'll await the first stage outcome ;)

the lawer told me that if i have exclusion order for one year they might refuse the permanent residency..stage 2...
