Hi, I have an issue with my wife visa, where me and my wife are separated for more than one year because she could not get a visitor visa to join me.

first, I am Libyan international student who,currently study in Waterloo university, Canada . last year, my wife applied for visitor visa to visit me on June 2015 and ,unfortunately her application get refused because our marriage considered as proxy marriage.

I spend the last year trying to find a solution but I did not find anything that will solve my issue.
could you please assist me to find a solution for a marriage contract that not recognize by Canadian law because of proxy marriage.

Note, I was in Canada when marriage contract was signed in Libya because of Unforeseen circumstances. Also, proxy marriage are allowed in my country Libya.

When did you get married? Starting June 10 2015 proxy marriages are no longer recognized by CIC:

I got married in February 2015, before proxy marriage were no longer recognized by CIC. but she still got refusal after she applied in June 2015

It doesn't matter when you were married - all that matters is when your application was received by CIC. As you know, proxy marriages are not recognized. You will have to visit her in her home country or meet up in person in a third country, get remarried to make your marriage recognized and then reapply.
 
Oh, Is it Ok to remarried !!, CIC will not have any issue to remarry the same person ( new marriage certificate ) ?

If so , is there any other document that will support may new marriage certificate ?

To CIC you are not married since proxy marriage was invalid. So you are not marrying someone again, you are getting married for the first time.
 
To the OP - we had the same problem CIC didn't recognize our Sharia court marriage from Jordan which was concluded proxy.

You don't need to get married to your wife again. Instead, your wife should register your marriage in Civil status department in Libya. And / or she can update her Libyan ID card to show that she is Married to you. Then you present these documents (notarized translated copies) to CIC.

1. You didn't, it still a proxy marriage, and will not be recognized.

Even then his wife has been denied the visa.
Now again he went there and did Nikah ah registration for the purpose of being together at the Nikah and to fulfill the requirement of Canadian spousal sponsorship law.
Do you think this will be accepted? Will it work?

Are you saying your son was there in person for all three wedding ceremonies? If that's the case, why was it declared as a proxy marriage? A proxy marriage means either the bride or groom are not there in person.

In our custom there are four steps of Marriage

First Nikah the religious ceremony

then henna ceremony

the reception from the bride

The reception from the groom

The Canadian law requires the bride and groom to be present on all the four

we have renewed Nikah that is the vows of Marriage by both being present at one place now

Yes - I understand the customs.

It's hard to say if this will fix the issue or not. People will often run into issue with spousal sponsorship for Nikah only. Since the rest was done by proxy in your son's case - hard to say what will happen. He can certainly try applying and see what happens.
 
He was present in all the three ceremonies with his wife .stayed with her for a month. Went to other City in the country to meet his relatives. Recently he lived from December last year till 20th of April with her he has returned after four months living with her.
Her passport and ID card is by his name
