Seriously, is this something that causes problems for a lot of folks applying outland and living exclusively outside Canada?

I never imagined this would be questioned, as long as the sponsor provides sufficient proof.

As I am a newbie to this whole process, I was hoping some senior members or those who have passed the "proof of intention to return to Canada" phase could shed some light for others...

Thanks!!

It wasn´t a problem for me at all. I am here on a student visa that expires in August 2012. And I also have a scholarship with a condition stating that I must return to Canada when I finish my studies.

So all I submitted as proof of intention to return was a copy of my visa where it says it expires, a copy a letter saying that I got the scholarship and a copy of the conditions where it says I must return to Canada.

I had no problem getting sponosrship approval.

It can be a problem, but usually either people submit enough proof to satisfy the visa officer at the beginning, or the visa officer will at least ask for more proof before deciding.
Note even if the sponsor is approved to sponsor, the PR can still be denied if the visa officer is not satisfied the sponsor will return to Canada.
Fencesitter, I am sure you have enough.

the only thing I am submitting is a letter from family stating we are going to live with them for 2 months. Also a letter stating we have a condo to rent when we get back (my sister owns a condo and will giive the tenants 2 months notice upon us arriving) and a letter from my employer stating I have work when I get back to canada (I currently work for a Canadian employer but live in Mexico)

I think you said in your previous posts you even have letters from the banks and mortgage letters etc and also infoabout closing your accounts in China. I'm sure you're golden. Sit back and relax and enjoy the wait :D

I provided a letter with an offer of employment. We also have a child so I think that helps show that we will stay together. I wrote a letter too. I don't think it's a big deal.

Just a side thought - why the heck would any couple want to pay Immigration 1040 to move to Canada if they weren't intending to move to Canada? Not to mention the cost for sending the app, preparing the app, medicals etc.
I think the fact that someone is willing to pay 1000+ dollars says a lot in itself. :) And with the information that you have - I think you're perfectly covered in this area.

My wife has sponsored me. My file is under process at the moment in Abu Dhabi. We got married in July 2010 and since then been living together. She applied for me in Oct 2011 after our first baby.

In their first email after they acknowledged the processing of the application. They had sent me a questionnaire with it. Out of many questions they had few questions asking me if my sponsor is still with me and what are our plans on moving back. They even wanted me to cancel her residency visa for Kuwait and focused on this that the PR visa will only be issued unless and until I show them that my sponsor will move back to Canada with me once I get the PR.

I did send them all the required document including a job offer I had from a business in Canada and my wife`s intention on joining her dads business once we move. A day after I had sent my documents I received a letter from them in mail asking me to do my medical. I did that and now waiting...any idea what is next?

I feel that my case is strong since we have a baby now and I have provided them with enough prove. But reading on forums here I feel every persons Visa office is different and every one has their own set of experiences with them. You cant predict any thing but just wait!!

The concern is the sponsored spouse would move alone. Like maybe it's a fraudulent marriage or they decided to live separely for employment reasons. Or they're separated and made a deal. They want the canadian to support the sponsored family by living in Canada with them. They don't always believe the sponsor will move with the applicant.

Because for a Canadian living exclusively with sponsored spouse, getting a PR card for the spouse would enable them to travel together in and out of Canada indefinitely where the spouse not wish to acquire Canadian citizenship or neither wish to become residents of Canada for tax purposes. It's difficult for the spouse to apply visitor visas otherwise unless the spouse holds visa exempted passport.

I will stand outside the Canadian Consulate in Hong Kong with signs to protest if they refuse my wife's PR based on a) genuineness of marriage and b) proof on intention to return to Canada. Seriously, I will do this...and I will contact every single person I know in the media to get this in the news...I will not allow my government to deny us when we have provided enough proof...the idea of "discretion" is ludicrous. They must have some kind of standard when assessing proof of intention...if the sponsor meets, let's say, 4 out of 6, pass.

I'm not going to give up, ever...this is too important for my family's future....I will also contact my dad to ask his lawyer about legal action if they do pull something stupid...

I feel the same way man. Except I don't know any lawyers :-[

Feels like applicants don't have basic human rights until such time as they get PR'd...

Which city are you guys going to immigrate to when you are successful?

I've been living w/ my husband in the States for about 12 years now. We don't have an employment offers in Canada right now and I just wrote a letter telling them that we are going to be living w/ my parents in Canada when we first move back for as long as we need to. My husband and I will look for jobs and my my older kids will be enrolled into elementary school. I also had my parents write a letter also that I included that also has their address and phone number if they need to contact them for additional info.

Don't worry! You'll get approved. Your application had no holes.
