my partner and i were living together before she moved to canada. Thing is we were living on her parents place so all bills are addressed to her parents. we didint get any mail either while she was here. we have a joint bank account, that's all i can think of as proof right now and i think that wouldnt be enough. Need help on other things that might help as proof. Thanks a lot!

You could get letters from her parents.

You say that you were living together before she moved, did she move after getting PR? And how long did you live together?

Hi, i believe you also need to send some proofs related to your relationship like, pictures which were taken while you're still together, exchange of emails, greeting cards., and stuffs like that. You must also include declaration by friends or relatives to prove the genuiness of your relationship. :) goodluck!

we found another problem, when she submitted her application as a provincial nominee she was not able to declare that we are in a common law relationship. If we file this common law relationship now, would it give negative impression on the visa officers since it was not declared?then eventually denying the petition,or even sanction her for "faking" her provincial nominee application?

Yes - that's a huge problem. If you lived together for a year before she landed in Canada and became a PR through the provincial program, then you should have been included in her application. Because you weren't included, she can't sponsor you. Forget about submitting the common law sponsorship application. If you do, it will definitely be refused and could create problems for her own PR status (since this will show she lied in her application).

why wasn't she able to declare your relationship? how long ago was her previous application? (ie. did your relationship exist at that time?) did u meet the common law criteria at that time?

application was january 2013 i think, yeah we did meet the common law criteria that time. we are planning to get married and use spousal sponsorship so we really didnt bother about the common law.

anyway,if i plan to visit her under tourist visa and get married in canada would that be easier?and would anyone know what documents should i bring with me for the marriage?

It wasn't your choice not to bother about the common law. If you were common law, it was mandatory that she include you in her application. If you became common law after the application was submitted but before she landed, then it was mandatory for her to add you to her application before she landed.

The challenge you'll face now is that even if you get married, if CIC finds out that you were common law previously (i.e. before your partner landed in Canada), your application will be refused.

let's say we push on getting married in canada, should i stay there until the application is approved or can i go back in my country as soon as we pass the application?

Applying outland or inland, I don't think you will be able to immigrate here via family sponsorship because your partner didn't declare you, that makes you inadmissible FOREVER.

I don't quite think you understand. If you were common-law (lived together 12 months) as of the date she landed in Canada as a PR, so she landed as SINGLE and not common-law... then if CIC ever finds out you guys were really common-law at that time, you can NEVER be sponsored to Canada by her ever, no matter if you get married or not or do inland or outland.
