The Questions on prohibitions page, is the answers only apply to your Eligibility period? Because I was asked to leave Canada earlier when I arrived in Canada 15 years ago only for that to be overturned by Appeal. Can someone help
The individual questions asked in item 16 "Prohibitions" (pdf/paper CIT 0002 (10-2020) version) refer to varying time periods. Some specifically refer to "now," like 16.1. asking whether the applicant is "now" on probation or parole, 16.3 asks where the applicant is "now charged" with an offence. Some refer to a time period of five years, which is concurrent with the eligibility period (see 16.6), another refers to a period of 10 years, while another refers to a period of 4 years.
Item 16.4 asks if the applicant
has ever been under a removal order. If the answer to this is yes, whether that was two years ago or twenty, the appropriate answer is "YES" and then the applicant provides a brief description in the box at the end of item 16. Checking "Yes" does not mean the applicant is not eligible. IRCC will review the details and determine whether the referenced event constitutes a present prohibition. It is NOT LIKELY a Removal Order or Departure Order 15 years ago would cause any problem so long as the situation was properly resolved.
They will almost certainly know about it even if the applicant fails to disclose it, that is answers falsely, which of course could make the applicant not eligible. To what extent such an omission would be held against the applicant is difficult to predict, ranging from being deemed a misrepresentation and grounds to deny the application, to being considered a minor oversight merely indicating the applicant cannot be fully trusted to be an accurate reporter of facts.
