Hi,

I sent my application for skilled worker to Sydney, NS on 03/31/2009, and it was received there (with staff signature) on 04/02/2009, before the current instructions existing on their web site were posted.
I am a little bit surprised by the new instructions posted on the CIC website with the date 04/01/2009 because, during the last week, I checked a couple of times per day the CIC website to be sure there are no changes until my application has arrived there, and until Friday 04/03/2009 EOD, the CIC website wasn't changed at all. Today I see many changes on the CIC website, including the one related to processing fee paid only in CAD, and surprinsingly they are dated as 04/01/2009. I find quite strange to have changes posted retroactive on the CIC website.

The instructions I used to prepare my application were posted here:

I am pretty sure that the previous instructions regarding processing fees had three sections where they were explaining what would happen for under/exact/over payment, and for the last case they were saying that they would start processing the application, and also they would send you a refund. Now the last case has completelly dissapeared from the CIC instructions.
There were also posts on this forum that were saying that it's ok to send USD for processing fee, so I would really appreciate if somebody can confirm that this was ok before 04/01/2009.

Does somebody know how my application would be considered if I sent my processing fee in USD and I did not send the new form IMM 5612 as a cover page for my application?

If the processing fee in USD is an issue, is possible to send them a letter with a certified checque for 550 CAD before they reject my application and send it back? If yes, how I will get the 550 USD back from them?

They've been very strict about the fees in CAD even before this new update. Usually they send back the application form asking you to make the correct payment/correct currency. The IMM 5612 may not be an issue since you sent the application before the new instructions were posted, but the fees definitely is. I'm not sure about sending the fees in CAD separately. Wait for seniors to reply. The USD will be refunded to you, but it will take a while, I guess.

Another idea would be to send another application, identical with the one sent last week, but having the attached certified cheque for processing fee in CAD (550).
If this is posssible and legal, how I can withdraw the first application and keep the second one, and how I can notify Sydney about the withdrawal of the first application?
If the withdrawal of the first application is not possible, is possible to have two identical applications in process until they reject the first one and send it back to me?
Also is 100% sure they would reject the first one and send it back to me? If yes, how long it could take?

Seniors, please help me with my questions.

Processing fees in CAD was in effect even before 4/1. I know it because my application was returned in Feb 09. Usually they are pretty quick in responding.. I got mine back with in 3 weeks.

I am not the expert.. first time user of this site. I happen to know the answer caz, I just went through this first step.

For all applications sent to CIU, Sydney , Nova Scotia, fees was to be paid only in canadian dollars.
This is effective atleast since Dec 2008 as I was trying to find a way of raising cad demand draft from my place. For me your option of sending identical application with cad draft is the best option as you are bound to get back usd cheque and application.
