Hello All

Can One WITHDRAW the processing fee of dependents (Spouse and 3 Kids)
incase of REFUSAL of Canadian Immigration Application?

I could not undestand your question. Can you clear.

If CIC refuse application at the initial stage before starting processing it due to 38 NOC list, or point matters etc. they will refund full money that is paid by the applicant.

under the new rules, withdrawal of processing fee depends at what stage your application was rejected.
out of interest, in case of a refusal, why would you only ask about withdrawing the processing fee for spouse and children and not for principal applicant?

The Processing was started and finally due to my B.Sc. Degree matter, They refused me in Jan 2007 (declaring me unable to enter canada for Two years which will be completed in Jan 2010) only One month for clarification which was insufficient. I have wrote them letter for more time but only got one month.

After 2 -3 months of Vefificatioin by University, since it was more than 10 year old record, they issue me B.Sc. Degree whith Clarification Letter.

Now I want to know whether I can wihtdraw All or Partial (my dependents)
processing fees?

No, the application was processed, refused, and the fees are kept.

First, Thanks for the Reply.

But as far as the fee is concerned, The Principal Applicant fee is suppose
to be NON-Refundable.

Where as the fees of the dependents are Refundable (I think).

What your opion.

It seems only fair that they refund the dependents' fees.

No wonder people apply alone at first and then after approval only they add their dependents. That certainly seems to be the safest way if this is the case.

Thunder2777, you say you were refused in 2007? Or did you get notified recently only? What does the refusal letter say? It should mention something about refunds if you're eligible.

The Refusal Letter did not included any info about Refunds. I also Assumed that Only my Processing Fee has gone and my Dependent fees are still there, untill now my reletive said that it (Me and My dependent Fees both) is gone too or you should atleast Redeem your Depenedent Fees.

I thought it would be better to ask before writing a letter to Embassy, so that if it is legal then I will get some reference to quote in my letter.

Also it is written on the CIC website that
If you apply as a Federal skilled worker and pay a fee, but are not found eligible according to the above criteria, we will inform you and refund your processing fee.

On the contrary, I was just refused and not being refunds.
One more thing to point out, I am NOT asking for my processing fee
but for my dependents fee.

Unfortunately, I think PMM is absolutely right here.

Firstly, from what I read here, usually if you are going to get a refund, you will be informed in the letter, which you weren't.

Secondly, check this out http://www.ci.gc.ca/english/information/faq/immigrate/skilled/skilled-faq03.asp
They demarcate 'not eligible' and 'refuse' here. From the info you have given, I do think it was a refusal. Sorry, bro.

Anyway, give it a try. Ask them to refund your dependents' fees at least. Good luck!
