Is someone (like company owner) transferring your salary from their account to your account or it is a direct deposit from your employer?

That is unfortunate. The onus of proving the deposits in your bank account are actually salary deposits is on you now.

What can you do to prove that?

The following are some of the things you can do to build a case for yourself.
  • Write a letter thanking them for getting back to you for clarification and politely explain your situation. Explain that the deposits on your account are actually salary deposits and also explain what further documentation you are submitting in order to conclusively substantiate your claim.
  • Submit all your paystubs that show the net amount which is the same as the amount deposited in your bank account as salary
  • Submit your Income Tax documents (Form 16 provided to you by your employer and the ITR) as proof of income. This will serve 2 purposes -
    • This might allow the officer to add up the deposits and check with the amounts in your income tax return. If they add up, this will help your case.
    • Form 16 will, obviously, contain your employer's name . This document gives immense strength to your claim and will prove that your employer has been paying you. If required, IRCC could further check with your employer / (or may be even with the income tax department) to see if that Form 16 and the ITR are valid.
  • Try and get a letter from your company that clearly mentions your pay
  • Submit your bank statements that shows this deposit for a larger period of time to prove that you have been receiving this deposit for a long time now (for example, if you had only submitted bank statements for 6 months, submit bank statements for as long as you can in the past). Make sure that these statements are stamped by the bank.
  • Make a self declaration on stamp paper explaining that the deposits in your bank statements are actually salary deposits and get this notarized.
I wish you all the very best!

If I was the opinion that just the "proof of company’s account statements" would be sufficient to prove your claim, I would not have taken the time to explain in detail the other documents that could be submitted.

I have provided what I think is the best approach in my previous post.

Whether you follow it or not is up to you.

If your pay is anything less than Rs. 250,000, you are officially not required to file a tax return (but it is strongly recommended that you do for purposes such as this).

AFAIK, if you are a salaried employee, you couldn't have filed an income tax return without Form 16. I assumed you have been filing your income tax returns and hence brought this up. Form 16 is prepared and provided to you by your employer.

Questions :
  • Have you filed a tax return lately?
  • Have you checked with your employer to see if they can issue a Form 16?
