Problems with PR Landing Timeframe

Hello everyone,

First some background info.

I applied in August of 2012 under spouse/family class from the USA so i can join my wife in Vancouver BC.

A few days ago i got an email from immigration asking about some financial stuff from my part that could complicate the application. The email stated: "39. A foreign national is inadmissible for financial reasons if they are or will be unable or unwilling to support themself or any other person who is dependent on them, and have not satisfied an officer that adequate arrangements for care and support, other than those that involve social assistance, have been made.", which really confused me because i thought that for BC, Canada there is no minimum income requirement.

At this moment i am a full time student working towards my degrees in Graphic Design, Web Design/Development, and Criminal Justice Administration.
With my hektic university schedule, I have a hard time finding someone who will employ me, even part time.
Also, my expected graduation date is April 2014, and plan to move to Canada permanently shortly after.
I am fortunate enough to be able to stay with my parents for the time being, and upon arriving to Canada, we have arranged for us to stay with my wife's family until we find a stable job and move out on our own.

I passed all this information forward to the immigration agent along with a few questions regarding the possibility of both my parents and my wife's family signing affidavits to this effect.

Their reply is as follows:

"Thank you for your email,

Please be advised that your medical results are valid till August 21, 2013,if you are unable to immigrate by that date, you will have to withdraw your application and re-apply.

Please let me know your decision as to when you will be able to immigrate to Canada."


My reply to them and questions i would like some help with are as follows:

I must admit I didn't think of this.

Would i be able to re-take my medical examination before the current one expires and have my application carry on until April 2014?

If not, would it be possible to make my PR Landing sometime in November/December, then return to USA to finish my last semester (Spring Term 2014 January- April), then upon completion in April 2014 return to Canada as originally planed?

I am sure there are many laws regarding this immigration application that i am not aware of and quite a few I probably don't fully understand, so being able to plan this out would be great. My priority is to be in Canada with my wife, but i would be devastated if I were unable to complete my education in Miami which i have worked so hard for as well.

Please, let me know if there is any relevant information that could help me and my situation.

So to sum it up;

What kind of financial information do i need from my end, and would i be able to show that i am working towards being ready to start my cureer in Canada and be able to support myself financially?
Also to this effect, can my parents and my wife's family be counted towards plans of being financially stable?

on the other note;

Would i be able to re-take my medical examination before the current one expires (August 2013) and have my application carry on until April 2014?
If not, can I land in november/december and return to the USA to complete my last semester (4 months in length) and upon completion return to canada permanently?


I know its a lot of information and a lot to read through, but any help would be greatly appreciated.

If there is anything that i should explain in more detail or information i should add, please let me know.

(Stage 1 + Stage 2)=23 months
once you get your COPR (confirmation of PR) you need to land before it expires. typically it expires at the date that comes first (a) medical expiry or (b) passport expiry. once you land, you would give your wife's address to the immigration officer at the entry and then you can leave a couple of days later. however when you do re-enter for good you will need to have your PR card that was mailed to your wife's address. the PR card can't be mailed via canada post, etc. if they know that the pr card is in there they may either refuse the parcel or send it back to CIC. best would be to have someone bring it to you, or have ur wife visit (if possible) and come back with her.

to keep your PR, you need to be in canada for 2 out of 5 years.

i'm not sure abt the rest, so i will let someone else answer that ...

My wife's PR card arrived at my parents' house last weekend. We just received it today in China. You can most definitely send it via courier. My dad just wrote 'Government of Canada documents' on the courier slip. No problem.

It's a risk doing it this way, but if you have to do it, you have to do it. Besides, the chances of anything bad happening are remote.

i guess that your main problem is to show your financial capabilty to support on landing. since you show some options, i guess that your relatives and friends in canada should write out some letters to you stating that they are willing to support you and your wife for whatever you woud need and that they are in search for a job on landing. the issue that you will be returning to finish your semester that is causing a doubt to the cic, this is my personal thoughts, i guess you should not have mentioned that because in anyway you could have return after landing
